Protest dismissed and authorisation to pay dividends was approved.

Facts:

Following Race 1 (CR Grace/ Awassi NZ 2200) a protest was lodged pursuant to Rule 642(1) by Mr J Parkes alleging that horse number 9 (BELINDABELLA) or its rider placed 1st by the Judge interfered with the chances of horse number 7 (TAKE THAT), placed 2nd by the Judge.

The information alleged interference in the final straight.

The official margin between 1st and 2nd placed horses was a short head.

Submissions for Decision:

At the commencement of the hearing, all available views of the final stages of the race were played – head-on, side-on and back straight camera angles.

Mr Parkes protested on the grounds that Ms Andrew moved outwards and took his rightful line of running around the 300m stage of the race. He used the back-straight camera to show where his mount TAKE THAT was well back in the field but running on strongly. He then used the head-on view to highlight the gap between Ms Andrew (BELINDABELLA) and Mr Hannam (AJAY LINCOLN) which he said was his rightful line of running. Mr Parkes maintained that this gap closed on him as a direct result of BELINDABELLA moving outwards. He had to ease for a couple of strides and angle for a run to the inside of Ms Andrew. Mr Parkes said the loss of momentum cost him the race and with a clear run he would have won by ½ length.

Mr Auret agreed with Mr Parkes and said TAKE THAT was a big striding horse, and the loss of momentum cost him the race.

Ms Andrew admitted that her mount ran outwards when she headed the horse to her outside ridden by Mr Hannam. She put her whip away and rode hands and heels. Ms Andrew believed that there was pressure from Mr Hannam’s mount as well which contributed to the gap closing for Mr Parkes.

Ms Clapperton agreed that Mr Hannam had contributed to the incident and said that Mr Parkes had 150m to try and get past BELINDABELLA but failed to do so.

For the Stewards Mr Balcombe said that Mr Parkes’ mount made up a lot of ground early in the home straight prior to the gap closing due to movement from both Mr Hannam and Ms Andrew’s mounts. He then had 200m with which to go past Ms Andrew, and while he made up some ground on the winner BELINDABELLA kicked back.

Reasons for Decision:

Rule 642(1) states:

If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

The Committee accepts that Mr Parkes riding TAKE OUT lost some momentum when forced to shift ground to the inside of the eventual winner BELINDABELLA. Mr Parkes was heading for a gap between Mr Hannam and Ms Andrew, but his run was disrupted as a result of the gap narrowing. The head-on film confirmed that not only did Ms Andrew roll outwards but also Mr Hannam contributed by moving inwards. Playing the films through until the finish of the race the Committee was not satisfied that Mr Parkes’ mount would have won the race had it received a clear run. Taking this into account, as well as the fact that Mr Hannam’s mount contributed, the protest was dismissed.
