The protest was dismissed and dividends authorised to be paid based on the judge's confirmation of placings.
Facts:
Mr N Goodwin alleged that in the home straight interference occurred when ANDALOU shifted inwards onto the line of SARAH JANE. The margin between 2nd and 3rd was a long head. The provisional placings as called by the judge were:
1st Gold Moet (R Hannam)
2nd Andalou (C Dell)
3rd Sarah Jane (Miss B Grylls)
Submissions for Decision:
Mr N Goodwin (Stipendiary Steward) using the available films submitted that in the run to the line at about the 200 metre mark ANDALOU was racing on the outside of the eventual winner GOLD MOET. SARAH JANE (Miss Grylls) was travelling directly behind. He informed the committee that SARAH JANE was presented with a gap between the two horses. As she moved into the gap, movement inwards from ANDALOU occurred. He submitted that the movement was about one horse width. The eventual winner GOLD MOET also, he believed, moved outwards slightly. He submitted that he believed Miss Grylls was entitled to that gap and that the head of her mount was in the gap when the movement occurred forcing Miss Grylls near the 100 metre mark to take hold and shift ground to get a run. Momentum was lost at an important part of the race and SARAH JANE, after being steadied, came home well. He reiterated again the margin was a long head between 2nd and 3rd.
Mr Dell had no questions of Mr Goodwin and Mr Ebbett asked if the eventual winner GOLD MOET'S movement could have contributed to the incident. Mr Goodwin reiterated that yes there was some slight inward movement from GOLD MOET.
Mr Dell submitted that this was ANDALOU'S first run back after a long spell and did race greenly and had blinkers on for the first time. He was of the opinion there was no clear run for SARAH JANE and believed that she was not of the stated distance into the gap when movement occurred. He conceded that he did move inwards but not the horse width distance alledged by Mr Goodwin and asked the committee to take into account the slight outward movement of the eventual winner.
Miss Grylls was asked by Mr Goodwin if there was a gap presented. She believed there was and felt the head of her horse was just in the gap when movement occurred. Miss Duthie had no questions or comments.
Reasons for Decision:
The two available films side and head on (there was no rear film available) showed that there was movement inwards from ANDALOU. All parties agreed that there was slight outward movement from the eventual winner GOLD MOET, which the committee believed was a contributing factor, albeit slightly, to the incident.A gap was presented for SARAH JANE at about the 200 metre mark. Conflicting views were given by the parties concerned on how far or if Miss Grylls had taken the gap, when the movement from the horses on either side of her occurred. The side on film was a little unclear and the committee, after viewing the head on film a number of times, believed it could not be determined satisfactorily. What was clear is that Miss Grylls took hold of her mount and changed ground to mount her run. Her horse did lose momentum when she took hold, and ran home well to get within a short head of the second place horse.
The committee took the view that for a number of strides there was room for SARAH JANE to mount her run between the two horses, GOLD MOET and ANDALOU. At the same time as movement occurred Miss Grylls elected not to continue with that course of action and changed ground. Considerable doubt existed in the minds of the committee as to the contributing factor of the movement of both horses to the incident, and of Miss Grylls' actions in not taking the gap available and electing to change ground. The committee cannot be certain that had Miss Grylls not decided to take hold and change ground from behind ANDALOU she would have finished ahead of that horse at the line.
