Decision: Following the running of Race 7 the Lion Foundation/Leopard Hotel Waipukurau Cup, Mr. T. Bambry, trainer of WADE, provisionally placed 4th by the Judge protested against the horses KATES TALENT (provisionally placed 1st by the Judge and KING EDWIN provisionally placed 2nd by the Judge

Following the running of Race 7 the Lion Foundation/Leopard Hotel Waipukurau Cup, Mr. T. Bambry, trainer of WADE, provisionally placed 4th by the Judge protested against the horses KATES TALENT (provisionally placed 1st by the Judge and KING EDWIN provisionally placed 2nd by the Judge alleging interference over the final 100m.

 Mr. Bambry informed the committee that approximately 100 metres from the finish his horse WADE was easily holding third when the two horses who finished 1st and 2nd place moved inwards onto his horses line causing WADE'S Jockey Mr. O. Bossom to take hold and stop riding.  He was adamant that the actions caused his horse to be denied a dividend bearing position.

 Both available films were shown and commented on by all parties during the course of the enquiry.  Jockey O. Bossom reiterated the comment made by Mr. T. Bambry that his line was dictated to by the other horses actions and that he did have to take hold approximately 70 metres from the finish.

 Mr. P. Bell (KATES TALENT) informed the committee that his line was dictated to by KING EDWIN on his outside.  He felt WADE did have room but when a call was made he straightened his mount and rode hands and heels to the line.  He believed his horses actions did not contribute to the incident.

 Mr. H. Tinsley (KING EDWIN) told the committee his horse did roll across but both horses were running on strongly and he felt it was a trouble free run to the line.  Mr. P Hurdle (trainer) felt the interference that did occur happened because of KING EDWIN's movement inwards.

 Mr. N. Goodwin (Stipendiary Steward) told the committee that KATES TALENT was entitled to the line she was on and the her movement inwards was, he felt, caused by the horse on her outside, KING EDWIN who came across just short of the line.

 Decision and Reason:

--

Rule 876 (i) required us to ask whether interference occurred and if so whether that interference has cost the horse interfered with from finishing in a better placing.  In our view the available films, especially the head on, is clear.  WADE was entitled to his line he was clearly running third when the two horses on his outside KING EDWIN and KATES TALENT moved inwards just short of the line causing Jockey Bossom to take hold and stop riding.  The provisional winner KATES TALENT upon reaching the lead was entitled to her line and her movement inwards was minimal until KING EDWIN rolled across.  We were convinced that the contributing factor to WADE's jockey having to take hold was KING EDWIN's inward movement onto KATES TALENT.

 In terms of the rules, we have discretion in relation to the placings.  Having been convinced that the contributing factor was KING EDWIN's inward movement the protest against the provisional winner KATES TALENT was dismissed.  However, we were convinced that the interference to WADE was caused by KING EDWIN's actions and we exercised our discretion to change placings.

 Accordingly, the placings now read 1st KATES TALENT, 2nd ZATIGER, 3rd WADE, 4th KING EDWIN.
