Decision:

The information alleged that near the 150m mark jockey M Tanaka permitted his mount MISS ROBYN to shift out when not clear of ALWAYS DREAMING (D. Bradley) resulting in ALWAYS DREAMING being badly hampered and in turn made heavy contact with SKIMBLE SHANKS (O. Bosson) on several occasions.



The information alleged that near the 150m mark jockey M Tanaka permitted his mount MISS ROBYN to shift out when not clear of ALWAYS DREAMING (D. Bradley) resulting in ALWAYS DREAMING being badly hampered and in turn made heavy contact with SKIMBLE SHANKS (O. Bosson) on several occasions.

 Mr. Tanaka did not admit the breach of the rule.

 Trainer Mr. R. Bergerson represented Mr. Tanaka who had limited ability with the English language.

 Mr. C. George (Senior Stipendiary Steward) showed the available films and informed the committee that Jockey Tanaka angled his mount out when not sufficiently clear and made contact with the horses on his outside.  He felt the actions were undertaken with little regard of the horses around him.

 Mr. R. Bergerson informed the committee he felt that there were mitigating circumstances and that the horse on Mr. Tanaka's inside did move out.  Mr. C. George in reply did not accept that there were any mitigating circumstances.

 Decision and Reason:

--

 The committee, after viewing the available films, found the charge proven.  The movement outwards when not sufficiently clear did cause contact to be made with the horses on Mr. Tanaka's outside.  The committee was of the opinion that the slight outward movement of the horse on Mr. Tanaka's inside did not contribute at all to the incident.  The charge was found proven.

 Mr. N. Goodwin informed the committee this was Mr. Tanankas first charge under the rule.  He felt that even though it was his first charge, the incident was serious enough to be warranted by a period of suspension.  Mr. R. Bergerson told the committee that this was the first time Mr. Tanaka had been in the enquiry room.  He has been in New Zealand for two years but has only been race riding for a few months.  He was conscientious and on loan from the other Rogerson/Autridge stable for a few months.  He did still intend to ride up north as well as the Central Districts.  Mr. Bergerson asked for a fine.

 In reaching a decision to suspend Mr. Tanaka the committee was mindful that it was his first offence.  However, the committee believed it was appropriate to suspend rather than fine Mr. Tanaka because of the degree of seriousness.  The committee was also mindful of Mr. Bergerson's statement that Mr. Tanaka would be riding in the northern area as well as the Central Districts and this was reflected in the period of disqualification.

 Mr. Tanaka was suspended from race riding from the completion of racing Sunday the 10th December until the completion of racing on Wednesday the 20th of December 2005.
