 As Mr Sweeney admitted the breach we find the charge proved.

Penalty:

Accordingly we impose a suspension on Mr Sweeney which will commence after racing on 9th October 2011 and conclude after racing on 16th October 2011(4 days).

Charge:

Following race 4 an information was filed pursuant to Rule 638(1)(d). The informant Mr Davidson alleged that Mr Sweeney permitted his mount VITE FILLE to shift outwards near the 500 metres forcing ROYAL MISS (A Collett) off its rightful line of running with CLOSE ENCOUNTER (J Collett) also being hampered.

Facts:

Mr Oatham demonstrated the video films which showed at the 500 metres Mr Sweeney attempts to get clear running on his outer when travelling well. However his outward movement was abrupt when not clear of ROYAL BLISS and CLOSE ENCOUNTER forcing the riders to check their mounts.
Mr Sweeney said he tried to make a run for his horse but conceded he was not subtle about it. 

Submissions for Penalty:

Mr Davidson produced Mr Sweeney’s record which showed 1 previous suspension in the last 9 months. He submitted the degree of interference was mid range and with Mr Sweeney’s early admission and his very good record a 4 day suspension would be appropriate.
Mr Sweeney informed the committee he had no firm commitments in the next seven days and would like the suspension to start immediately. He confirmed he rode as far south as Ashburton. He acknowledged he would not be riding at Winton on 12th October 2011.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. The mitigating factors are Mr Sweeney’s admission of the breach and his very good riding record. The aggravating factors are his level of carelessness which we assess as mid range which resulted in 2 riders being hampered. The committee and Stewards accept Mr Sweeney does ride as far south as Ashburton.
