Accordingly, Mrs Satherley had her license to ride in races suspended for a period to commence after racing on 12 May and conclude after racing on 20 May 2018.
The race meeting at Invercargill on 13 May was not included in Mrs Satherley’s penalty because the declaration of riders had closed.
Facts:
Following the running of race 6, Waipa Home of Champions 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mrs Satherley permitted her mount SECRET DREAMS to shift inwards when not sufficiently clear of SEIRIOS which was forced inwards crowding MISTER PINNS which was checked near the 1150 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
This hearing commenced after the last race and Mrs Satherley initially denied the breach. However, prior to the start of the hearing Mrs Satherley advised the Committee that she wished to change her plea.
Mrs Satherley acknowledged that she understood the Rule and confirmed that she admitted the breach.
Mr Oatham demonstrated the incident using the available video footage. He identified that SECRET DREAMS was racing in a 4 wide position with 3 horses to her inside. He said Mrs Satherley permitted her mount to shift in when only a bare length clear of SEIRIOS which in turn was ½ a length ahead of MISTER PINNS which was checked near the 1150 metres.
Mrs Satherley said that she was not aware there were 3 horses racing to her inside when she shifted in and added that no rider had called out to her. She accepted that her manoeuvre dictated SEIRIOS into the line of MISTER PINNS which was checked.

Mr Jones produced Mrs Satherley’s record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being 12 January. He described the level of carelessness as low range.
Mrs Satherley advised that she had firm engagements on 12 May at Rotorua and sought a deferment to fulfil those engagements. She had nothing further to add.

The Committee carefully considered all the evidence and submissions presented.
It was clear from the video films that Mrs Satherley permitted her mount to shift in 1 horse width near the 1150 metres when not the required distance clear of SEIRIOS. This resulted in that runner being dictated into the rightful running line of MISTER PINNS which had to be restrained by its rider.
The Committee deemed the level of carelessness to be low range and adopted 6 national riding days as the starting point which is in accordance with the JCA Penalty Guide.
The mitigating factor was Mrs Satherley’s admission of the breach for which she was afforded a 1 day reduction in penalty.
The Committee deemed Mrs Satherley's record to be average and a neutral factor given that she has had approximately 300 race day rides in the last 12 months.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
