As the breach was admitted the charge was found proved.

Penalty:

Balancing the above matters but with emphasis on the need for consistency with other penalties imposed for a breach of this rule, a fine of $500 is imposed. Pursuant to the mandatory provisions of rule 648(3), there is an order that BELLE KIRK is disqualified. This order resolves the request for a ruling filed by Stipendiary Steward Mr Williamson on Information No. 41607.

Omitted towel when saddling BELLE KIRK.

Facts:

Mr Williamson said that Ms M Wenn rider of BELLE KIRK weighed in .6kg light. This is outside the .5kg allowed under the rules. Enquiries revealed that Mr Lock when saddling the horse prior to the race omitted to put a towel under the saddle.

Mr Lock agreed with the comments of Mr Williamson. He said the horse was playing up when he was saddling it.

Submissions for Penalty:

Mr Williamson said Mr Lock had no previous breaches of this rule recorded against him. He said the offending was mid range. He referred the committee to penalties imposed for other breaches of this rule. Those penalties were mainly a fine of $500. He submitted that a fine in the vicinity of $500 should be imposed.

Mr Lock agreed with that submission.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr Williamson and the acceptance of them by Mr Lock, his clear record and agrees the offending is mid range. The committee also takes into account the penalties imposed in earlier similar cases.
