As the breach was admitted we find the charge proved.

Penalty:

Balancing the above matters with emphasis on the need for consistency, a fine of $150 is imposed.

Presented JUSTINE’S PRIDE and LADY LOVE to race with the incorrect saddlecloths.

Facts:

Mr Williamson said Mr Johnston was acting in a caretaker role for Trainers G and D Rogerson. When saddling JUSTINE’S PRIDE and LADY LOVE he transposed the two saddle cloths. The mistake was detected at the time the horses were having their plates inspected. The mistake was rectified before the horses were brought into the birdcage.

Mr Johnston agreed with the facts as stated by Mr Williamson.

All other gear on both horses had been properly applied.

Mr Williamson said Mr Johnston had no breaches of the rules recorded against him. The offending was mid range. He referred to two other penalties imposed for a breach of this rule. One penalty was a fine of $150 and the other a fine of $300. He submitted that a fine consistent with those penalties be imposed.

Mr Johnston accepted the submission of Mr Williamson. He said this was the first mistake of this kind he had made in a period of 2 years that he had been working for the trainers. He apologised for the mistake.

In fixing penalty the committee takes into account the admission of the breach, the clear record of Mr Johnston, the submission of Mr Williamson and the acceptance of it by Mr Johnston, the other comments made by Mr Johnston and views the offending as mid range. The committee also takes into account its research of penalties imposed for breaches of this rule. The usual fine imposed is in the vicinity of $150.
