As Ms Dravitzki has admitted the breach we find the charge proved.

Penalty:

The Committee therefore imposed a period of suspension of Ms Dravitzki's riding license which is to begin after racing on 9th April and conclude after racing on 23 April 2016, 3 days.

21 April            Woodville

23 April            Trentham

Facts:

Following the running of Race 6, the NZB INSURANCE PEARL SERIES RACE 1150, an Information was presented by Mr Jones alleging that Apprentice Rider Ms M Dravitzki permitted her mount The Secret's Out to shift outwards when not sufficiently clear of The Keept Lady which was checked near the 250 metres.

Ms Dravitzki was present at the hearing and acknowledged that she understood the Rule and that she admitted the breach. Ms Dravitzki was assisted in the hearing by Mr Noel Harris, Apprentice Riders Mentor.

Rule 638(1)(d) provides ' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.

Using the available video films Mr Coles identified the horses involved in this matter. At about the 300 metres mark The Secret's Out was alongside the running rail with The Keept Lady outside it. Mr Coles stated that Ms Dravitzki then directed her mount outwards towards The Keept Lady in order to improve her position. At the time The Secret's Out was about 1/2 to 3/4 length ahead of The Keept Lady, forcing its rider Mr L Magorrian to check that horse. Mr Coles said that the interference wasn't the 'worst' he had seen, however added that Ms Dravitzki was never the required distance clear when attempting to improve her mount's position.

Ms Dravitzki agreed that she had not been clear of Mr Magorrian's mount when she attempted to improve her position and repeated that she knew she was culpable in this matter.

Mr Harris added that Ms Dravitzki had just 'overdone it' when trying to improve her position. He added that it appeared that Mr Magorrian was intending to take the gap which Ms Dravitzki took but was not travelling well enough to do so.

Submissions for Penalty:

Mr Jones produced Ms Dravitzki's riding record which showed no breaches of this Rule since mid 2015. Mr Jones stated that the Stipendiary Stewards viewed this breach to be in the low to mid level on the scale of seriousness. He added that Ms Dravitzki was considered by the Stewards to be a Central District rider and her attendance at today's meeting - which was an Apprentice Riders only meeting - should not qualify her to be considered a North Island wide rider. Mr Jones stated that the Stewards believed that this breach could be dealt with by way of a suspension reflecting the lower level of the breach involved, and Ms Dravitzki's very good record.

Ms Dravitzki stated that she understood that she could not be considered a North Island rider and that she accepted the consequences of that. She said she had engagements at Trentham on Saturday 9 April and could start any suspension after that day.

Reasons for Penalty:

The Committee carefully considered the submissions by the parties. We took into account Ms Dravitzki's admission of the breach and her record relative to this Rule which we considered to be excellent. We also agreed with Mr Jones that the breach was at the lower end of the scale. Ms Dravitzki was asked if she could provide the Committee with any reasons why meetings in the upper North Island should be considered as part of her suspension, given that the way the Racing Calendar is programmed over the next few weeks she may face a longer period of being unable to ride, however she stated that she could not.
