Accordingly, GURU GIRL was declared a non-starter as per rule 632.
Facts:
Following the running of Race 7, Freight Lines Te Awamutu Cup 2000, an Information was filed pursuant to Rule 632. The Informant, Mr Coles, requested a ruling to determine whether GURU GIRL was denied a fair start due to mechanical failure of the gate.
Rule 632 provides that:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.
Submissions for Decision:
Mr Coles demonstrated on the head - on video film that GURU GIRL’S gate was clearly slow to open and in his opinion the horse was denied a fair start. He noted GURU GIRL hit the front of the gate when she attempted to jump out. He said this incident cost GURU GIRL about 2 lengths.
Miss Myers said the video footage was plain to see that her mount GURU GIRL was denied a fair start. Miss Myers said her aim was to ride her mount handy but when the gates opened she hit the front of the gates which cost her at least 2 lengths.
Mr Thornton said GURU GIRL was normally a good beginner and he could not understood why she was at the rear of the field shortly after the start.
Mr Moody said it was clear on the video footage that GURU GIRL’S gate was slow to open.
Reasons for Decision:
The Committee carefully considered the submissions presented and reviewed the video films. It is very clear GURU GIRL’S starting stall was slow to open due to a mechanical failure. The Committee is satisfied this materially prejudiced GURU GIRL’S chances. The side on video film is compelling that GURU GIRL lost approximately 2 lengths at the start which prevented her from taking an effective part in the race.
