Accordingly the protest is dismissed and the Judge's placings shall stand. In conclusion I order the payment of stakes and dividends.
Facts:
Following the running of Race 2, Gourmet Delicious Ltd 1150, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr A Forbes, alleged that PENZANCE placed 1st by the Judge interfered with the chances of MARTINIZ SPECIAL placed 2nd by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing were as follows:
1st No.5 PENZANCE
2nd No.3 MARTINIZ SPECIAL
3rd No. 2 SCUSA
4th No.7 JEWEL OF THE NAKI
The official margin between 1st and 2nd was ¾ of a length.
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
All connections present acknowledged they understood the Rule.
Submissions for Decision:
Mr Forbes submitted that he felt like his horse was going to burst past PENZANCE over the final stages of the race. He said PENZANCE rolled out a fraction and checked his mount severely inside the last 100 metres. He believed the interference denied his mount the opportunity to win the race.
Mr Ralph submitted he concurred with Mr Forbes' assessment of the incident. He stated it was a safety issue when MARTINIZ SPECIAL had its running line taken by PENZANCE.
Mr McRae, speaking on behalf of his apprentice Miss Moki, submitted that he can’t see where the damage is. He was of the opinion MARTINIZ SPECIAL had every opportunity to get past PENZANCE in the final straight. He added PENZANCE was holding out MARTINIZ SPECIAL well in the run to the finish line.
Mr Walker submitted PENZANCE did run out near the 75 metres but disputed MARTINIZ SPECIAL would have run straight past his horse. He said PENZANCE was always holding out MARTINIZ SPECIAL in the final straight.
Mr Coles when asked for the Stewards' interpretation of the alleged interference submitted that there were two points the Committee needed to consider. He was of the view MARTINIZ SPECIAL had made up 2 lengths on PENZANCE from the 200 metres to the 75 metres. However, he stated the alleged interference occurred at the 75 metres and questioned whether MARTINIZ SPECIAL would have made up ¾ of a length on PENZANCE at the finish.
Mr Forbes in summing up submitted he was unable to hit his horse with the whip when PENZANCE rolled out.
Mr Walker in summing up submitted the interference was not severe and PENZANCE had the edge on MARTINIZ SPECIAL.
Reasons for Decision:
The Committee carefully considered all evidence and submissions presented and reviewed the video films several times. It is clear that PENZANCE did shift out in the final straight when it was in the lead. The alleged interference did occur at approximately the 75 metres when MARTINIZ SPECIAL was forced to change ground for several strides. At that point MARTINIZ SPECIAL was running on but not taking sufficient ground off PENZANCE to justify a change of placings. It is the opinion of this Committee that PENZANCE was always holding a comfortable margin on MARTINIZ SPECIAL in the final straight. I note the official margin at the finish was ¾ of a length which is a significant fact.
