Decision: Following race 2 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendiary Steward Mr J Oatham that Mr C Lammas, rider of CULLCHA, passing the 1200 metres allowed his mount to shift in when not clear
DECISION & REASON:
--Following race 2 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendiary Steward Mr J Oatham that Mr C Lammas, rider of CULLCHA, passing the 1200 metres allowed his mount to shift in when not clear of DARALDO (A Webb) resulting in that horse being checked.

Mr Lammas admitted the breach.

Stipendiary Steward Mr A Coles demonstrated the video films and showed when at the 1150 metre mark Mr Lammas angled his mount inwards and took the line of DARALDO when not the required distance clear. Mr Coles said although Mr Lammas did have a look, he was only ¾ length to 1 length clear when moving in and made an error of judgement.

Mr Lammas agreed it was an error of judgement.

Mr M Williamson stated it was a clear shift in when not the required distance clear and cost DARALDO 2 lengths.

Mr Williamson produced Mr Lammas’ record which showed he had not had a charge in the last 6 months, but had recorded 3 minor charges in the previous 6 month period. Mr Williamson said it was a fair record and submitted a suspension of 4 – 5 days would be appropriate.

Mr Lammas informed us he had firm engagements for Ruakaka on 12 July 2008.

PENALTY:
--The Committee considered all submissions and before imposing a penalty took into account the following:
--1. Mr Lammas’ record.
--2. His guilty plea.
--3. Confirmed engagements for 12 July.
--4. The severity of the interference received by Mr Webb.
----
Accordingly, we impose a suspension to start after racing on 12 July 2008 and conclude after racing on 23 July 2008 – 4 days.
