As Mr Bayliss admitted the breach the Committee found the charge proved.

Penalty:

Mr Bayliss was fined $250.

Facts:

Following the running of race 4, Pic Insurance, an Information was filed pursuant to Rule 649 (1)(a). The Informant, Mr Williamson, alleged that Mr Bayliss changed his riding boots after weighing out.

Rule 649(1) (a) provides: A Rider must not:

(a) do or permit any wrongful act or omission with respect to weight or weighing;

Mr Bayliss said he understood the Rule and confirmed that he admitted the breach.

Mr Williamson advised the Committee that Mr Bayliss was booked to ride TAWNY WAY at 54 kgs. He said that Mr Bayliss weighed out at 54.4 kgs and when he weighed in he was 54.7 kgs. At that point the Clerk of Scales noticed that Mr Bayliss had changed his riding boots. He said the difference was 0.3 kg and the Stewards could only assume Mr Bayliss changed his riding boots to ensure he was not more than 0.5 kg over the carded weight.

Mr Bayliss told the Committee that he has been riding in “paper weight boots”. He said that he had borrowed Mr S McKay’s saddle and was told that the stirrup irons would be aggressive on his feet. He said that is why he changed his riding boots.

Submissions for Penalty:

Mr Williamson said that Mr Bayliss had a clear record under this Rule and reiterated that there was not a great difference with the weigh in weight. He said a monetary fine of not less than $200 would be appropriate.

Mr Bayliss accepted that a monetary penalty would be appropriate.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The JCA Penalty Guidelines starting point for a breach of this Rule is fact dependant.

The JCA database shows that similar types of this rare breach have generally incurred a low range fine.

The mitigating factors were Mr Bayliss’ admission of the breach and his clear record under this Rule for which he was afforded a small discount in penalty.

After taking into account all the above factors the Committee considered that an appropriate penalty was a $250 fine.
