Decision:
Following race 5 an Information was filed pursuant to Rule 638(1)(d).The Informant, Stipendiary Steward Mr A. Coles alleged, that near the 250 metres EVATHREESTEP(C Ormsby) shifted in when not clear of MONTINA DIVA (J Collett) causing that horse to clip heels and blunder.

--Mr C Ormsby admitted the breach and was present at the hearing.
--Stipendiary Steward Mr Williamson demonstrated the video films which showed at the 300 metres Mr Ormsby riding Evathreestep was racing in a 4 wide position when he allowed his horse to shift in when only a bare length clear and in doing so take the rightful line of Montina Diva ( J Collett) who clipped heels and blundered. He stated there were some mitigating circumstances with Mr Ormsby’s horse changing legs coming around the bend.
--Mr Ormsby said he thought his line was clear and was unaware that Mr Collett was on his inside. He confirmed his horse had changed legs and in doing so layed in.
--PENALTY SUBMISSIONS
--Mr Coles said Mr Ormsby had a very good record with 3 careless riding charges over the last year. He believed there were some mitigating circumstances which resulted in the incident and submitted a suspension at the bottom end would be appropriate.
--Mr Ormsby said he had firm commitments at Ellerslie on 3.11.09 and Paeroa on 4.11.09 and wished the suspension to start after racing on 4.11.09.
--PENALTY
--The Committee carefully considered the evidence and submissions presented. We took into account the guilty plea, Mr Ormsby good riding record, the interference suffered by Mr Collett, Mr Ormsby’s firm riding commitments and the mitigating circumstances of his mount changing legs.
--Accordingly we impose a suspension from race riding to start after racing on the 4th November 2009 and to conclude after racing on the 10th of November 2009 (4 Days).
