Decision: Following race 5 an information was lodged by Stipendary Steward Mr A R Coles pursuant to Rule 871(1)(d) when he alleged that M T Coleman breached that rule when he permitted his mount BANNERMAN MAGIC to shift inwards near the 1200 metres

Following race 5 an information was lodged by Stipendary Steward Mr A R Coles pursuant to Rule 871(1)(d) when he alleged that M T Coleman breached that rule when he permitted his mount BANNERMAN MAGIC to shift inwards near the 1200 metres when not sufficiently clear dictating PIRATE FLAG (M Sweeney) inwards tightening LITTLE TURBO ( O Bosson) into CARISBROOKE (C Grylls) who was sharply checked.

Mr Coleman did not admit the breach.

Mr Williamson demonstrated the alleged offence on the video. He showed where, near the 1200 metres, Mr Coleman on his mount BANNERMAN MAGIC was making an inward movement from his 11barrier draw. As the field aproached the turn Mr Sweeney on PIRATE FLAG could be seen to make an inward movement which put pressure on Mr Bosson riding LITTLE TURBO and in turn on to Mr C Grylls riding CARISBROOK.

Mr Williamson accepted that PIRATE FLAG had over reacted however he maintained that although Mr Coleman had 4 horses on his inside, and there was a gap between Mr Coleman and Mr Sweeney, Mr Coleman was less than 4 horse widths from the running rail. Mr Williamson said that PIRATE FLAG could be seen to be over racing and also Mr Yusof, on the inside, could be seen to move out a little from the inside rail.

Mr Sweeney stated that he suffered interference from the outside as he approached the 1st bend. He said he was probably just one length behind Mr Coleman. He agreed with Mr Coleman that the horses did not touch as his mount moved away from Mr Coleman’s.

Mr Bosson, rider of LITTLE TURBO said that he suffered pressure from the outside. He was a ½ length behind Mr Sweeney as their horses made contact.

Mr C Grylls said that he received pressure from the outside and had to check his mount. He said that after observing the video he realized that there was a little movement from his inside but the major pressure was from the outside. He felt he had lost at least 1 length.

Mr Coleman, in his defense, claimed that there was always a gap on his inside. He did not deny that there was inward movement by Mr Sweeney but stated that there had been no contact between their mounts and felt that there had been an over reaction by PRIVATE FLAG.

In summing up Mr Coles did not deny that there had been inward movement by Mr Sweeney but claimed that although there appeared to be a clear gap inside Mr Coleman this had been caused initially by his dictating the line of Mr Sweeney.

After reviewing the videos and considering the evidence the committee is in no doubt that the initial inside movement was caused by Mr Coleman continuing his inward movement when not sufficiently clear of Mr Sweeney and therefore dictating his line

--

In finding Mr Coleman guilty we do accept that PIRATE FLAG did over react but consider that this initial movement was caused by Mr Coleman’s error of judgment.

PENALTY

--

  Mr Coles gave Mr Coleman’s very good record of eleven and a half  months without a charge. He felt that the penalty should be a suspension and asked for one of 4 days.

Mr Coleman said that he had ridden in  610 races since his last charge. He also gave notice of his riding commitments.

--

The committee, after considering all submissions including Mr Coleman’s good record and the lower level of interference suspends Mr Coleman from race riding beginning after the finish of racing on 2 August till after the finish of racing on 8 August 2008. (4 days)
