Decision:

Because Mr Dell was not the required distance clear of Ms Collett when moving in we find the charge proved.

Penalty:

Accordingly, we impose a suspension on Mr Dell which will commence after racing on 8th May 2012 and conclude after racing on 14th May 2012 ( 6 days).

Charge:

Following race 4 an information was filed pursuant to Rule 638(1)(d). The informant Mr Williamson alleged that passing the 1300 metres (SEVEN FIFTY) C Dell shifted in when not sufficiently clear dictating (CIARLATANO) A Collett in onto (JEEPERS KEEPERS) A Taylor which was forced into the line of (BLACK ATTACK) M Cropp which was checked sharply losing ground.

Facts:

Mr Coles demonstrated the incident by using the head on films. He advised the committee to focus on the second set of interference received to BLACK ATTACK. He believed this is where Mr Dell is careless in allowing his mount to shift ground when not the required distance clear. Mr Coles pointed out to the committee that Mr Dell was racing in a 7 wide position prior to angling his mount in on a sharp angle to end up in a position 2 off the rail. However, in doing so he dictates the line of 3 horses on his inside which resulted in BLACK ATTACK receiving a sharp check and losing ground. He said the side on films showed that Mr Dell was only half a length clear of Ms Collett's mount when angling in.

Mr Sanders questioned Mr Coles interpretation of the films believing that the interference had occurred prior to Mr Dell angling his horse in. Mr Coles demonstrated again to Mr Sanders the point of interference which the stewards deemed to be careless, emphasising that Mr Dell had shifted in on too sharp an angle when not sufficiently clear. This movement resulted in Mr Dell dictating the running line of 3 horses on his inside.

Mr Williamson called Ms Collett as a witness. She told the committee that she received pressure from Mr Dell's mount who was racing on her outer. She believed Mr Dell was 1 length clear of her prior to dictating her mount in.

In response to a question from Mr Dell, Ms Collett admitted she had intended to move in at a later stage in the race however was dictated in earlier than she had planned by Mr Dell's mount.

Ms Taylor was called by Mr Williamson as a witness. She told the committee that she had received interference from Ms Collett who was racing on her outside. She believed that Ms Collett was ¾ of a length clear of her mount at the point of interference.

Mr Dell questioned Ms Taylor as to whether her mount had been over racing at the time she received tightening. Ms Taylor acknowledged that her mount was not racing kindly, but she did not believe that this contributed to the eventual pressure on BLACK ATTACK.

Mr Williamson called his final witness Mr Cropp. He told the committee that he received pressure from his outside which resulted in his mount been hampered badly. He said Ms Taylor had received pressure from her outside and was only half a length clear of his horse when shifting in.

Mr Dell demonstrated the incident by use of the video films. His interpretation was that Ms Taylor's mount was racing fiercely and this had contributed to the incident. He said he was coming in on an angle but at no point did he put any pressure on Ms Collett's mount.

Mr Sanders said that there was no contact between Ms Collett and Mr Dell's mount. He believed all the interference happened prior to Mr Dell coming across from his outside barrier draw. He was of the opinion that Ms Taylor's mount was responsible for causing interference to BLACK ATTACK.

Mr Williamson in summing up said he was aware of the racing manners of Ms Taylor's horse which exaggerates the interference. However he said the rule clearly states that riders need to be their length and another clear when shifting ground. He said at no stage was Mr Dell clear to shift in onto Ms Collett, with her never being in a position to relieve the pressure. He said the level of interference to Mr Cropp's horse was significant.

Reasons for Decision:

The committee carefully considered all of the evidence as presented. Having reviewed the video films several times we established that Mr Dell has erred in shifting in from the outside barrier draw when only half a length clear of Ms Collett. This inward movement resulted in tightening to 3 runners on his inner with BLACK ATTACK receiving a severe check and losing valuable ground. The sharp angle in which Mr Dell moved in was the reason for the crowding and the following interference.

We looked at the respondent's evidence, however the video films do not support their interpretation of the incident. The committee is mindful that contact does not have to occur for there to be interference between horses.

Submissions for Penalty:

Mr Williamson produced Mr Dell's record which showed 3 previous breaches of this rule in the last 12 months. He said Mr Dell is to start a suspension after racing on 2nd May and conclude after racing on 8th May 2012, this suspension occurred last Saturday. He submitted that Mr Dell's carelessness was` mid range and Mr Cropp's mount received a severe check. He believed an appropriate penalty was a 5 to 7 day suspension.

Mr Dell submitted that prior to Saturday he had been suspended on only 2 occasions, which he considered to be very good. He informed the committee that he rode all over the country but did not wish to comment on penalty.

Mr Sanders had no submissions for penalty.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The committee is aware that Mr Dell will commence a suspension after racing on 8th May 2012. We assess the level of carelessness to be mid range and note Mr Cropp received a severe check. We believe Mr Dell's record as it sits now can only be described as average. We accept that Mr Dell does ride all over the country. After considering and balancing all the above facts we determine an appropriate penalty is one of 6 days.
