Decision:
An information was lodged by stipendary steward Mr. J. Oatham with regard to Race 8 at Waipa Racing Club meeting held on 3rd November 2007 where it was alleged that defendant Mr. L. Callaway breached rule 871 (1)(d)
An information was lodged by stipendary steward Mr. J. Oatham with regard to Race 8 at Waipa Racing Club meeting held on 3rd November 2007 where it was alleged that defendant Mr. L. Callaway breached rule 871 (1)(d) in that he permitted his mount MY HANGOVER to shift inwards near the 1000 metres when not sufficiently clear of VOLSCAR (C.Lammas) who was dictated into the line of HAGAR (BR.Jones) who was checked with MY HANGOVER then again shifting in taking the line of VOLSCAR who was checked.
--As this charge related to an incident at Waipa race meeting held on the 3rd November 2007, a letter of authorization was produced signed by the CEO of NZTR giving permission for Mr J. Oatham to charge Mr L. Callaway for breach of rule 871 (1) (d).
--Mr. Callaway who was represented by Mr S Simon admitted the charge.
--As the charge was admitted we only had to adjudicate on penalty.
--Mr Williamson demonstrated the video that clearly showed Mr Callaway moving across when not sufficiently clear and dictating the line of VOLSCAR. Mr Callaway continued to shift in and in doing so took the line of HAGAR. Further pressure on VOLSCAR resulted in that horse taking a check as well.
--Mr J Oatham said that the penalty should definitely be in the form of a suspension. He gave Mr Callaway’s record of three suspensions in the last twelve months and that he considered that if was only fair.
--Mr Callaway said that he rode at all races in the North Island and because of the amount of races he rode in he considered his record to be good.
--The Committee taking into account his record and the fact that he admitted the breach agree that a suspension is warranted.
--We therefore suspend Mr Callaway from conclusion of racing on the 10th November to the conclusion of racing on the 16th of November 2007 – 3 days.
