Following race no. 8 Jockey J Waddell, rider of 3rd placed horse PENNY FLORENCE, no. 6, protested against the second horse PIN UP BOY, no. 2. ridden by K O'Hara.



Following race no. 8 Jockey J Waddell, rider of 3rd placed horse PENNY FLORENCE, no. 6, protested against the second horse PIN UP BOY, no. 2. ridden by K O'Hara. The protest was brought pursuant to Rule 876 (1). This was a connection protest.

All parties with an interest have had notice of these proceedings. Mr Newham and Mr Sargeant, respective trainers, confirmed all parties were present, being J Waddell, J Sargeant, G Newham and K O'Hara.

The informant, Jockey J Waddell, alleged that PIN UP BOY or its rider, placed second by the Judge, interfered with the chances of PENNY FLORENCE placed 3rd by the Judge. The alleged incident took place in the final straight at approximately the 200 metres mark.

Mr J Waddell demonstrated the incident on all race videos (head on and side on). Mr Waddell, in summary, said that at about the 200 metres PIN UP BOY moved in dictating his line, "he had to take hold", lost momentum for 4 - 5 strides. He said that the interference cost him 3 lengths. Mr Sargeant supported Mr Waddell's evidence.

Mr Newham, trainer of PIN UP BOY, disagreed it cost him 3 lengths. He asserted that he was inconvenienced a stride or two which would only cost him a head or neck margin. Ms K O'Hara confirmed Mr Newham's observations.

Mr Oatham did not accept the interference cost him 3 lengths and said take into account the 1/2 length margin between 2nd and 3rd.

The committee has carefully considered the evidence (including head on / side on race videos) and we find minor interference occurred at the 200 metre mark when PIN UP BOY moved in slightly on PENNY FLORENCE. It is necessary for us to consider whether that interference interfered with the chances of PENNY FLORENCE, placed 3rd by the Judge.

we do not find the chances of PENNY FLORENCE were interfered with gaining a better placing. The protest is dismissed.
