DECISION AND REASON:
--Following Race 7 an information was laid against jockey, Mr C Lammas, alleging careless riding, Rule 871(1)(d).
--The information reads:
--"C Lammas permitted his mount SEA JAZZ (No.5) to shift inwards near the 800 metres when not sufficiently clear, dictating EL NADIA (No.10), ridden by Ms M Wenn inwards causing severe crowding to FIXINTOFLY, ridden by Mr G McKeon, and DEFIES LOGIC (No.17) ridden by Mrs L Satherley."
--Mr C Lammas admitted the breach of Rule 871(1(d).
--Facts:
--Stipendiary Steward Mr M Williamson, demonstrated the incident on the race videos. In summary, at approximately the 800 metres mark Mr Lammas permitted his mount SEA JAZZ to shift inwards when not sufficiently clear, dictating EL NADIA (M Wenn) inwards causing severe crowding to FIXINTOFLY and DEFIES LOGIC, ridden by Mrs Satherley.
--Mr C Lammas accepted the interpretation of Mr Williamson as fair and accurate.
--The only issue for determination is one of penalty.
--Mr Oatham sought a suspension in the circumstances.
--After hearing all submissions on penalty from Mr Oatham and Mr Lammas and taking into account the following -

- Excellent riding record, no prior riding charges in last 12 months and his last riding charge was 15 July 2006. --
- Pleas of guilty/explanation that his horse was a difficult ride and over racing, his move in slightly an error of judgement. --
- Three other runners suffered interference. --
- Degree of carelessness.
We accept Mr Oatham's submissions that a suspension be imposed. We grant a deferment of the suspension because of your important riding engagements at Te Rapa.
--Conclusion:
--Mr Lammas' jockey's licence is suspended from the conclusion of racing on Saturday 10 November 2007, up to the conclusion of racing on Thursday 15 November 2007 (3 riding days).
