Accordingly the protest is dismissed and the judge’s placings shall stand.

Facts:
Following the running of Race 7 Mr R Otto, trainer of the second placed horse STATE OF ELATION, lodged a protest pursuant to Rule 642(1). He alleged that ORINDA, placed first by the judge, caused interference to STATE OF ELATION in the final straight.
The judge’s placings were as follows:
1st ORINDA no.14
2nd STATE OF ELATION no.2
3rd PARNELL PRINCE no.5
4th RELEASE ME no.9
The official margin between 1st and 2nd was a head.
Submissions for Decision:
Mr Otto demonstrated the alleged incident using the head on and side on video films. He said in the final straight he believed the chances of STATE OF ELATION were affected because ORINDA had bumped his horse on 2 occasions in the straight. He said his horse was unlucky being hampered with the official margin being a head.
Ms Johnson said ORINDA who was racing on her inner gradually moved out 3 or 4 horse widths in the straight. She said her mount was bumped and off balance during the incident.
Mr McKee said it was obvious on the films that ORINDA had changed its running line. However he said he did not believe there was any interference or loss of momentum to STATE OF ELATION as a result of the movement. He said the side on films confirmed that ORINDA was the stronger finisher of the 2 horses in the straight believing that STATE OF ELATION had peaked on its run in the final 30 metres. He did not believe viewing the video films that there was anything definitive in the straight to justify a change of placings.
Ms Spratt said that her mount had come out a little bit forcing her to drag her mount away from STATE OF ELATION. She said she had to stop riding her mount with the stick and felt ORINDA was always holding out STATE OF ELATION in the final straight.
Mr Williamson when asked for his assessment said the committee had to consider the evidence put before them. He said the films did show that contact had been made between the 2 horses. However he said the Stewards did not support a change of placings as it was difficult to prove that STATE OF ELATION would have beaten ORINDA.
Mr Otto when summing up said he believed STATE OF ELATION was forced over more ground and confirmed the winning margin was a head.
Reasons for Decision:
The committee carefully considered all evidence and submissions and reviewed the video films. The films showed at the top of the straight STATE OF ELATION had moved up alongside ORINDA to challenge for the lead. ORINDA who was racing on the inside does shift out and brush STATE OF ELATION on 2 occasions in the straight. Ms Spratt does take corrective action and drags her mount away from STATE OF ELATION. Ms Johnson continued to ride her mount forward in the final straight and was noticed to be using her whip strongly in the final 75 metres. At no stage in the straight did STATE OF ELATION look like gaining the upper hand over ORINDA.
The video films showed that ORINDA was definitely finishing the race off the strongest. We believe if Ms Spratt did not have to stop riding and drag her mount away from STATE OF ELATION the winning margin would have been greater. For these reasons we are not satisfied that STATE OF ELATION would have beaten ORINDA.
