As Mr Hutton admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, Mr Hutton is fined $225.

Facts:

Following the running of race 6, JF Grylls Memorial Classic, an Information was filed pursuant to Rule 636 (1)(d). The Informant, Mr Jones, alleged that Mr Hutton failed to ride his mount THE SHACKLER out to the end of the race.

Mr Hutton acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach. Mr Harris supported Mr Hutton at the hearing.

Rule 636(1) (d) provides: A person being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;

Mr Oatham demonstrated on the video footage that THE SHACKLER was racing in or near the lead and in the last 20 to 30 metres Mr Hutton stood up in the saddle when racing in 5th position. He said THE SHACKLER was pipped in the last few strides to finish 6th beaten by a short head.

Mr Hutton acknowledged that he stopped riding his mount out with approximately 20 to 30 metres to run. He said THE SHACKLER had a hard run outside the leader and in his opinion the horse was giving his best. He said in hindsight he should have ridden his mount out using hands and heels to the end of the race.

Mr Harris said Mr Hutton misjudged the situation.

Submissions for Penalty:

Mr Jones produced Mr Hutton’s record which showed no previous breaches under this Rule. He advised the Committee that 5th place prize money was $300. He said the JCA Penalty Guide recommended a starting point of a $300 fine. Mr Jones submitted a fine in that vicinity would be appropriate.

Mr Hutton submitted that his horse had a hard run and the 5th placed horse ran on from the rear of the field.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Hutton’s admission of the breach, his clear record in relation to this Rule and we note that THE SHACKLER had a torrid run on the speed. However, it is clear on the films that Mr Hutton relaxed his ride well before the finish line which cost him 5th place.

The Committee referred to similar breaches which showed the fines imposed ranged from $150 to $300.

After taking into account all the above factors the Committee considers an appropriate penalty is a $225 fine.
