As Ms Grant has admitted this breach we find the charge proved.

Penalty:

We therefore impose a period of suspension of Ms Grant's license to ride in races, to commence after the completion of racing today and conclude after racing on 9 July 2016 - 4 days.

Facts:

Following the running of Race 5, the TE AWAMUTU TYRE CENTRE 1150, an Information was lodged by Mr Jones alleging that Apprentice Rider, Ms R Grant allowed her mount CONRWIN to shift out near the 250 metres when not sufficiently clear of MODERATION which clipped a heel.

Ms Grant is apprenticed to Mrs K Fursdon who was not at this meeting. Her stable representative had left the course. Mr N Harris, Apprentice Riders Mentor was present at the hearing to advise and assist Ms Grant, who told the Committee that she understood the Rule and that she admitted the breach.

Rule 638(1)(d) states ' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless;.

Stipendiary Steward, Mr M Williamson, using the available video films described the incident. He pointed out Ms Grant, riding CONRWIN as the field approached the 250 metres mark. The horse MODERATION, ridden by Ms T Thornton, was outside her. There was a run available for one horse ahead of these runners, and Ms Grant allowed her mount to move outwards towards MODERATION when not the required distance clear of that horse. By attempting to obtain the run ahead of her, the pressure Ms Grant put on Ms Thornton caused her to take evasive action, and doing so her mount clipped the heels of the horse ahead of her - ENJOY THE RIDE, ridden by Ms A Collett. Mr Williamson stated that MODERATION had begun to weaken whereas CONRWIN was mounting a run, and eventually finished third, and that he considered the incident to be a 'timing' issue by Ms Grant. He also said that Ms Thornton anticipated the incident and took a hold of her mount which helped mitigate the 'damage'.

Mr Harris told the Committee that the facts were as pointed out by Mr Williamson. He said that Ms Grant had anticipated that MODERATION  was slowing quicker than it actually was, and that the incident was due to an error of judgement on Ms Grant's part.

Submissions for Penalty:

Mr Jones produced Ms Grant's riding record which showed no prior charges of any type during her short career. Mr Jones said Ms Grant had ridden in 15 races in New Zealand.  He added that the JCA Penalty Guide provided a starting point of a 5 day suspension for a breach of this Rule. Mr Jones said that the fact that MODERATION had clipped heels with the horse ahead of it was an aggravating factor and submitted that a suspension of 4 days may be an appropriate penalty. He further stated that there was no history of Ms Grant riding outside the Northern area, and that the Stewards felt this breach was in the low-mid range on the scale of seriousness.

Ms Grant told the Committee she had previously ridden in England and Scotland and had ridden 4 winners from around 56 rides. In answer to a question from the Committee Ms Grant stated that she had no confirmed rides at any upcoming meetings and could commence any suspension after racing that day.

Reasons for Penalty:

The Committee considered the submissions of the parties. We believed that the breach was in the lower level on the scale, however the fact that the affected horse had clipped heels inclined us to take a slightly more serious approach when assessing an appropriate penalty. We accept that Ms Grant has had a limited career and that she has admitted the breach. We believed that the incident called for a period of suspension, and that we could allow Ms Grant some credit for her clear record, and her admission of this breach.
