Decision:

On the basis of the admitted breach by Mr Kasim, we find the charge proved.

Penalty:

Accordingly, we impose a suspension on Mr Kasim which will commence after racing on 29 May and conclude after racing on 4 June 2012. (4 riding days).

Charge:

Following race 6, an information was filed pursuant to rule 638 (1) (d). The Informant, Mr Williamson alleged that Apprentice Jockey H. Kasim permitted his mount, HUNTERS CREEK to shift inwards near the 1200 metres when not sufficiently clear of FORBIDDEN LOVE (R Norvall) which became awkwardly placed on the heels of HUNTERS CREEK and shifted in, crowding HANDSOME AS (P Turner) which clipped a heel and blundered.

Facts:

Mr Oatham demonstrated the incident by using all available films. The head on film of the back straight showed HUNTERS CREEK (H Kasim) was approximately 5-6 width's off the running rail. A length back and inside of him was FORBIDDEN LOVE, who was racing ungenerously at this point, and a further length back on the running rail was HANDSOME AS (P Turner). As Mr Kasim took HUNTERS CREEK toward the running rail he crowded FORBIDDEN LOVE, which tended to hang inwards, with rider R Norvall taking remedial measures to correct his line of running, forcing that runner into the line of HANDSOME AS who clipped the heel of FORBIDDEN LOVE and dipped badly losing 2 lengths at that stage.

The side on film confirmed that Mr Kasim's mount was a bare length clear at the time of the incident.

Submissions for Penalty:

Mr Williamson produced Mr H Kasim’s record for the Committee, which showed 2 suspensions in the last 12 months, which he considered a good record. He said the racing manners of FORBIDDEN LOVE had not helped the situation and he conceded the interference to be "lower end". He suggested an appropriate penalty to be one of a 4-5 day suspension.

Trainer L Noble also felt that Mr Norvall’s mount had contributed to the interference, but conceded that Mr Kasim had crossed too soon when not clear.

Mr Kasim, when asked, confirmed he was not riding in the South Island.

Reasons for Penalty:

The Committee carefully considered the evidence and submissions presented, including Mr Kasim’s admission of the breach, his good riding record and the level of carelessness which the Committee found to be at the lower end of the scale. However, the aggravating factors were, the fact he was a bare length clear when crossing Mr Norvall’s mount and that the subsequent check to Mr Turner was significant.
