Race Number:
Race 8
Decision: --
Following race 8 a protest was lodged pursuant to Rule 876(1) when it was alleged by the informant, Mr R Norvall, that DIAMONDS AND RUST ridden by Mr S Saad interfered with the chances of his mount BRIANNA near the 800 metre mark and in the final straight.
--
DECISION & REASON:
--Following race 8 a protest was lodged pursuant to Rule 876(1) when it was alleged by the informant, Mr R Norvall, that DIAMONDS AND RUST ridden by Mr S Saad interfered with the chances of his mount BRIANNA near the 800 metre mark and in the final straight. DIAMONDS AND RUST was the declared winner and BRIANNA placed third.
----The margin at the post between second and third was ? of a length.
----All connections were notified of the protest.
----The connections of BRIANNA were the trainer, Mr D Sellwood and jockey R Norvall. DIAMONDS AND RUST was represented by trainer, Mr S Clothworthy, part-owner Mr P Francis and jockey Mr S Saad.
----Mr Norvall demonstrated the video films and showed where he believed interference occurred at the 800 metre mark. He said DIAMONDS AND RUST moved out, bumping his mount and unbalancing it. In the home straight he said he suffered further interference when DIAMONDS AND RUST again moved out forcing him from approximately 8 wide to 11 wide. He said this interference cost him more than ? of a length.
----Mr Sellwood, trainer of BRIANNA, said his filly was hampered which had to have affected its chances a wee bit.
----Mr S Saad, rider of DIAMONDS AND RUST, said his horse was running well, but a little bit greenly and did not think he had really made contact.
----Mr Clotworthy, trainer of DIAMONDS AND RUST, said his horse had moved out slightly, but there had also been inward movement from BRIANNA, which meant both horses were racing erratically. Regarding the home straight he said that his horse had moved out but there had been no contact and Mr Norvall had not stopped riding at any stage.
----Mr Francis, part-owner of DIAMONDS AND RUST, reinforced Mr Clothworthy's comments.
----Mr Oatham when asked for comment confirmed the margins of a head and ? of a length. In respect of the first interference he said there was some contact, minor interference but this occurred some distance from the post and was not conclusive anyhow. In respect of the home straight interference, he said Mr Norvall was lugging out and moving away from the eventual winner. He said any contact was minor and the Committee should consider the ? of a length margin at the post between second and third.
----The Committee found that there was slight interference at the 800 metres mark between BRIANNA and DIAMONDS AND RUST, but this was caused by both horses racing erratically. With regard to the home straight interference we believe that while DIAMONDS AND RUST did move out and slightly hamper BRIANNA we determined this was insufficient to affect his chances of finishing in a better place. Accordingly the protest is dismissed and the Judge's placings shall stand.
