Decision:

As Ms Cowan admitted the breach the Committee found the charge proved. 

Penalty:

The Committee was advised that the suspension incurred at Ruakaka the previous day concludes after racing on 4 July 2018. Accordingly, Ms Cowan’s licence to ride in races is suspended for a further 7 (national) days, commencing after racing on 4 July and concluding after racing on 19 July 2018. The meeting on 6 July was not considered as it is a jumps rider’s only meeting.  

Facts:

Following the running of race 8, the Livingstone Building NZ LTD, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Coles, alleged that the rider of SHOWTENAIRE, Ms Cowan (Class B)allowed her mount to shift in near the 850 metres when insufficiently clear of CRAFTYEVA which was checked”.

Ms Cowan acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using available video footage Mr Williamson identified the horses involved in the incident. He said that as the field approached the 850 metre mark SHOWTENAIRE was the second widest runner on the track and two spaces to her inside was CRAFTYEVA (M Cameron). He said that Ms Cowan allowed her mount to shift in two horse widths resulting in CRAFTYEVA being checked and losing several lengths. He said that CRAFTYEVA also made contact with CAMEAHOTFRIDAY. Mr Williamson said the check to CRAFTYEVA was more severe due to Ms Cowan steadying her mount when shifting in and he added the inward shift was abrupt.

Ms Cowan advised the Committee that the inward shift was an error of judgement on her part. She acknowledged the check to CRAFTYEVA was a mistake as she was unaware Mr Cameron’s mount was racing on her inside.

Mr Harris said that Ms Cowan’s intent was to go forward rather than allowing her mount to cross abruptly. He added, at the moment she is trying too hard and this may be affecting her judgement. 

Submissions for Penalty:

Mr Coles produced Ms Cowan’s riding record which showed 3 previous breaches; namely;
On 5/10/17 she incurred a 5 day suspension
On 3/11/17 she incurred a 5 day suspension
On 17/6/18 she incurred a 6 day suspension
He said the most recent breach occurred at the previous days meeting at Ruakaka and it was unfortunate because up until then Ms Cowan had not breached the careless riding rule for over 7 months. He said that the level of carelessness on this occasion was mid-range and submitted a suspension in accordance with JCA Penalty Guidelines would be appropriate.

Ms Cowan said that she was very sorry and reiterated the breach was a mistake on her part and she offered no excuses. 

Reasons for Penalty:

In consideration of penalty the Committee carefully considered all the evidence and submissions presented.

Our interpretation of the incident was that Ms Cowan allowed her mount to shift in at least 2 horse widths into the rightful running line of CRAFTYEVA. The inward shift was quite severe and CRAFTYEVA lost considerable ground. We accept the shift was an error of judgement on Ms Cowan’s part, but nevertheless the shift fell well below the standard expected of a rider in such circumstances. We assessed the level of carelessness to be mid-range and accordingly applied an 8 day suspension starting point.

In assessing penalty the factors that we considered included Ms Cowan’s admission of the breach; her contrition; her riding record which we assessed as fair and a neutral factor. We also considered the impact of the check suffered by CRAFTYEVA. Taking those matters into account we determined that a 7 national day suspension appropriate on this occasion.
