As the breach was admitted we find the charge proved.

Penalty:

After taking all the above factors into account we impose a fine of $200.  The committee emphasised to Mr Ormsby that any further breaches to this rule would be treated much more seriously.

Excessive use of the whip.

Facts:

Following race 5 an information was filed pursuant to rule 638(3) (b).  The informant Mr A Coles alleged that Mr C Ormsby used the whip excessively on his mount STAGEHAND.

Submissions for Decision:

Mr Williamson demonstrated the video films which showed STAGEHAND ridden by Mr C Ormsby leading the field approaching the home turn.  Mr Williamson pointed out Mr Ormsby striking his mount approximately 13 times before the 200 metres without giving the required respite of 6 strides.

Mr Ormsby in admitting the breach said he had just returned from Australia where backhand whip strikes without restriction are acceptable.  While admitting this was no excuse he said he would not have won the race if he had stopped riding his mount forward.  He stated the whip helped his momentum.

Submissions for Penalty:

Mr Coles said Mr Ormsby had a clear record under this rule under the last 12 months.  He added that as Mr Ormsby had gained an advantage by his use of the whip, he believed a fine of not less than $300 would be appropriate.

Reasons for Penalty:

The committee carefully considerd all evidence and submissions as presented.  Mitigating factors are Mr Ormsby's admission of the breach and his clear record under this rule in the last 12 months.  It was clearly evident on this occasion Mr Ormsby failed to give his mount the required respite of 6 strides.  However in Mr Ormsby's favour he was riding the favourite which was responding to the whip resulting in his winning the race by a nose.
