Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that R Allwood, rider of ALLEZ OOP, committed a breach of that Rule

DECISION & REASON:
--Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that R Allwood, rider of ALLEZ OOP, committed a breach of that Rule when he angled his mount outwards when not the required distance clear of HARRY WHO (L Cheshire) who clipped a heel and stumbled badly.
--Mr Allwood who was represented by Mr D Walsh did not admit the offence.
--Miss L Cheshire, rider of HARRY WHO, said that coming round the turn R Allwood came out very quickly and nearly took her mount's front legs out from under her. She said he was only half a length clear when he angled out.
--Mr Coles in demonstrating the video films showed Mr Allwood angling his mount out approximately two horse widths when barley one length clear of HARRY WHO on his outside. Mr Coles felt that SHELOVESATRIP (M Williamson) who was in front of Mr Allwood was always far enough in front as to not contribute to the resultant interference.
--Mr Allwood said in his evidence that he was following SHELOVESATRIP who was in his opinion only half a length in front of him. He said he got close to SHELOVESATRIP?S heels and felt he would have clipped them if he had not moved out. He also felt his horse over-reacted.
--Mr Walsh said that Mr Allwood was close to SHELOVESATRIP?S heels while anticipating a run on the rails. Through this he got himself into trouble and had to move out. He said that the action was accidental with no intention on Mr Allwood's part.
--Mr Oatham, in his summing up, said that Mr Allwood was never in danger and was always well clear of SHELOVESATRIP?S heels. He himself elected to angle out and at no stage did he take hold of his mount to maintain his correct line.

After reviewing the evidence the Committee are in no doubt that Mr Allwood angled ALLEZ OOP out when not sufficiently clear of HARRY WHO on his outside who as a result suffered severe interference and nearly fell. We do not accept that there was insufficient room between ALLEZ OOP and SHELOVESATRIP. Any inconvenience R Allwood found himself in was due to his own action. Accordingly we find the charge proven.
--PENALTY:
--Mr Oatham, in his submission on penalty, said that Mr Allwood had resumed riding for about five months and had 80 rides. This was his first charge and asked that we take into account his inexperience, but also his not guilty plea. He believed a suspension was warranted.
--Mr Walsh asked the Committee to consider Mr Allwood's inexperience, his good record, and the fact this was his first charge since resuming riding.
--Having taken all factors into account we agree that a suspension is warranted. We agree that Mr Allwood does have a good record, but we must also take into consideration the fact that a horse was nearly brought down through his actions. Accordingly we impose a term of suspension to commence at the conclusion of racing on 16 November until the conclusion of racing on 23 November, 4 days.
