Decision:

For these reasons the committee is not satisfied that CARNIVA BOY would have beaten ST MARITZ if interference had not taken place. Therefore the protest is dismissed and the judge's placings shall stand.  We order the payment of stakes and dividends accordingly.

Facts:

Following race 2 a protest was lodged pursuant to rule 642.  The informant Mr Hills alleged that ST MARITZ, placed 1st by the judge, interfered with the chances of CARNIVA BOY placed 2nd by the judge.  This interference was alleged to have occurred in the final straight.

The Judge's placings were as follows:

1st 4 ST MARITZ

2nd 3 CARNIVA BOY

3rd 6 FIFTYSHADESOFGREY

The official margin between first and second was half a length.

Submissions for Decision:

Mr Hills demonstrated the video films and pointed out where he was racing behind the leader, ST MORITZ, and hard on the rail approaching the 200 metres. He said shortly after this ST MORITZ rolled out pushing him over extra ground. He stated this cost him more than the 1/2 length margin which was the margin between his mount and the winner at the post.

Mr Maina said there was no gap on the inside for Mr Hills to take so he had to come to the outside of St Moritz which then led him to be forced over extra ground.

Mr Grylls said he was leading the field after turning for home and while admitting he has rolled out he said at no time did Mr Hills have to stop riding. He than added he himself had taken a hold and eased up when his mount moved out briefly. Mr Grylls concluded by saying that CARNIVA BOY was not hampered and had every chance to get past him.

Mr Malcolm said that ST MORITZ was always going too well and CARNIVA BOY had every chance.

Mr Robinson, when asked for his appraisal of the incident, conceded that Mr Grylls moved out approximately 2 horse widths but believed CARNIVA BOY has overreacted to this movement. He concluded that the Stipendiary Stewards could not support the process.

Mr Hills, in summing up, reiterated that the extra ground he had to cover cost him the race.

Reasons for Decision:

The committee considered all the evidence and reviewed the video films several times.  While we concede that ST MARITZ has moved out it was clear there was no contact between him and the second horse CARNIVA BOY.  It was also noticeable that Mr Grylls himself stopped riding to correct his mount losing momentum in the process.  The films also showed that Mr Hills did not stop riding and although he was forced over extra ground, the committee is satisfied that ST MARITZ was always holding a comfortable margin over CARNIVA BOY in the run to the post with the half length margin at the post being relevant in the decision.
