Decision: Following Race 3 an information was filed pursuant to Rule 871(1) (d) by Stipendiary Steward Mr A Coles in that Miss N Collett rider of GO JIMMY GO  permitted her mount to shift inwards near the 150 metres when not sufficiently clear of TRINNEY (G Cooksley) who was checked.

Miss Collett did not admit the breach and was represented by her employer Mr R Collett.

Stipendiary Steward Mr J Oatham demonstrated the video films which showed Miss Collett mount GO JIMMY GO  at the 150 metre mark shift inwards by two horse widths when being ridden forward with the whip , and in doing so take the line of TRINNEY (G Cooksley) on her inside. She was only approximately ¾ length clear of Mr Cooksley, who had to take a hold of his mount and was checked out of the gap. Mr Oatham stated there was slight movement from the inside horse CLYDE RIVER but he believed this horse maintained his rightful running line, and did not contribute to the interference.

Mr R Collett believed there was movement from both sides and he questioned Mr Oatham  regarding the movement from the inside horse CLYDE RIVER  shifting out towards TRINNEY  as he maintained this horse contributed to the closing of the gap, and subsequent interference.

Mr A Coles called rider Mr Cooksley as a witness who stated there was movement from inside and his outside. He believed Miss Collett was 1 ¼ clear when she shifted in towards his mount, Mr Cooksley had called out to warn Miss Collett.

Mr Coles in summing up said he believed there was movement by Miss Collett when not the required distance clear, and Mr Cooksley was entitled to the run that was available.

DECISION

--

The Committee carefully considered all the evidence and reviewed the films. We are clearly of the opinion that Miss Collett did shift ground into the line of TRINNEY when not the required distance clear. Accordingly we find Miss Collett guilty as charged and asked for submissions on penalty from Mr Coles and Miss Collett.

Penalty Submissions

--

Mr Coles said that Miss Collett had four suspensions this year. He submitted a suspension of 4 to 6 days would be appropriate, and informed the committee that Miss Collett did travel to South Island race meetings.

Miss Collett said she had firm commitments up to and including Te Rapa on 8.11.08

Penalty

--

The Committee carefully considered all submissions and before imposing a penalty, took into account the following:

--

1: Miss Collett’s record.

--

2: Level of interference and resulting check received by Mr Cooksley.

--

3: Miss Collett’s engagements in the next 7 days

--

Accordingly we impose a suspension to be served by Miss Collett starting after racing on November 8 and to conclude after racing on November 14 2008 (5 Days).
