Decision: Following the running of the 7th race at the Geraldine Trotting Club on 29 November 2008 an information was lodged by the Stipendiary Stewards alleging a breach by Mr Burgess of Rule 864 (2) (b) in that Mr Burgess used a boring pole in poor condition with that boring pole breaking at the start. 

Following the running of the 7th race at the Geraldine Trotting Club on 29 November 2008 an information was lodged by the Stipendiary Stewards alleging a breach by Mr Burgess of Rule 864 (2) (b) in that Mr Burgess used a boring pole in poor condition with that boring pole breaking at the start.  The information was lodged with the Registrar at 4.48 pm. that day. Mr Burgess had left the course at that time and the hearing was opened and adjourned.

Mr Burgess, now having been duly served with the information, has admitted the breach and advised the Committee in writing that he did not wish to be present.

Mr N McIntyre, on behalf of the Stipendiary Stewards, said that the Stipendiary Stewards observed the boring pole on Silverdale Pride break at the start of the race. On the return of the horse to the bird cage it was noted that the shaft of the boring pole was broken in half and that it was in poor condition. Mr McIntyre advised the Committee that Mr Burgess had said that he had borrowed the pole and was not aware of its condition. The charge is found proven.

Mr McIntyre advised the Committee that Mr Burgess had no previous convictions under this rule in the last twelve months and recommended a monetary penalty only.

The Committee after taking into account the incident itself and the recommendation of the Stipendiary Stewart, agreed that a fine only is appropriate, the Committee imposed a fine of $100.00.
