Facts:
Mr Wallis demonstrated that over the last 300 metres of the race the defendant used his whip on some 22 occasions on VIC N ART. The defendant explained that the horse was “in with a chance” and he had not realised until he viewed the videos with the Stipendiary Steward, that he had used the whip that many times.
Submissions for Penalty:
Mr Wallis produced the defendant’s record, which was clear under this rule over this and the previous season. Mr Williamson has had 580 drives in this time. Mr Wallis submitted a fine of $200 was appropriate. Mr Williamson did not disagree with this submission.
Reasons for Penalty:
We agree that the defendant has used the whip 22 times on VIC N ART in the last 300 metres. Some of these were quick fire strikes, while 2 or 3 at the 100 metre mark especially, were quite forceful. Having regard to the defendant’s record, which is excellent in respect of this rule and his ready admission of the breach, we accept Mr Wallis’s submission as to penalty.
