Mr Wallis alleged that in race 11, Mr G O’Reilly drove BANYULA FELLA in a careless manner when attempting a run on the inside of ARDLUSSA EXPRESS with 150 metres to race, resulting in his horse breaking.
Facts:
Mr Wallis had Mr McIntyre, stipendiary steward, demonstrate on the videos that just after the 200 metre mark the defendant went for a run on the inside of ARDLUSSA EXPRESS which had drifted briefly away from the markers. He said there was never enough room and that with approximately 150 to race BANYULA FELLA broke. The horse then drifted out of the race but did not interfere with any other horse.
Mr O’Reilly said at the time that he thought there was a gap as ARDLUSSA EXPRESS had drifted out a little but he now accepted that there was insufficient room for him to improve on the inside of that horse.
Submissions for Penalty:
Mr Wallis described the breach as being low end. He produced the defendant’s record, which was clear under this rule for the past 12 months. He submitted a fine of $250 was appropriate. Mr O’Reilly asked us to consider a lesser fine and said that he did not want to be suspended.
Reasons for Penalty:
We agree that the breach is low end. It is fortunate that the only horse affected was BANYULA FELLA. There was never enough room for that horse to make a run on the inside of ARDLUSSA EXPRESS. Taking into account the defendant’s excellent record of some 270 drives without a breach of this rule in the last 2 seasons and his admission of the breach, we agree the matter can be dealt with by way of a fine.
