Facts:
Following the running of race 9 the Woodlands Stud Handicap Trot Stewards lodged a protest into the second placed runner Red Hot Rocket alleging a breach of rule 870 (5) in that “Red Hot Rocket galloped across the finish line and was lapped on by the third placed horse Picketts Ridge.”
Rule 870 (5) reads:
Notwithstanding the provisions of sub-rule (4_ hereof any horse which is not in the correct gait when its nose reaches the finish line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse shall be at the discretion of the Judicial Committee.
Mr Smith indicated on the information he did not contest the protest or wish to attend the hearing.

Mr Ydgren stated that Red Hot Rocket was challenging wider out on the track. Approximately 20 metres from the finish it broke from its gait, free of interference, and galloped across the finish line in second place. Picketts Ridge which was placed third by the judge was a nose behind at the line. He stated Mr Smith had done everything to restrain his horse and get it back to its correct gait, but was unable to do so. He was seeking the relegation of Red Hot Rocket from second to third placing.
Reasons for Decision:
After viewing the video replays it is clear that Red Hot Rocket broke free of interference, its horseman made every attempt to return it to its proper gait, and that it was lapped on at the finish line.
