Mr Robertson admitted the breach and it is found proved.

Facts:

Following the running of race 4 the Aon Insurance Pace stewards lodged an information alleging that trainer Mr P Robertson “…did not securely fasten the hopples so as not to come adrift.”

Rule 864 (2) (d) reads:

Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-

(d) all gear is correctly applied and/or affixed so as not to malfunction or come adrift.

Mr Robertson admitted the breach and did not wish to appear at the hearing.

Mr Ydgren stated that normally this charge was dealt with by way of a minor information, but he believed the seriousness of this particular breach required a charge under the rule.

Mr Ydgren, with the aid of the video replays, stated Ain’t Nothing Bettor was placed handy to the leaders at the winning post with a lap to run. He said the off-front hopple carrier came adrift, causing the hopple to drop down around the horse's fetlock. Ain’t Nothing Bettor stumbled briefly and had to be retired from the event. He said the hopple slipping down caused the horse to knuckle over and break from its gate, causing interference to another runner. He said it was a serious breach which could have led to injury to either horse or driver.

Submissions for Penalty:

Mr Ydgren stated it was Mr Robertson’s first breach of the rule. Normally a minor infringement notice was a standard $100 fine, but under the circumstances he sought a fine of $150. Mr Robertson made no specific submissions on penalty.
