Evidence:
Following the running of the Nevele R Stud Fillies & Mares Mobile Pace, an information was lodged by Stipendiary Steward Mr SP Renault alleging Mr J Ovens, Junior Horseman, …continued to use his whip unnecessarily over the concluding stages when not in a position to run in a stake bearing place.

Rule 869 provides as follows:

(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

Mr Ovens admitted the charge and appeared at the hearing.

Mr Renault stated that Mr Ovens (Lucy Holmes) struck his horse approximately 10 times in the home straight, when never in a position to finish in a stake bearing position. Lucy Holmes finished in 9th placing about 12 lengths from the winner and 9 lengths from the fourth placed stake bearing horse Zena Mac.

Mr Ovens stated he worked the horse regularly for its trainer and was attempting to keep her mind on the job by using his whip in the home straight.

Decision:

After hearing the evidence and viewing the video the charge was found proved.

Submission For Penalty:

Mr Renault said Mr Ovens was in his first season as a Junior Horseman and had had over 20 drives. He had no previous or similar charges under the Rule and had a good record. However, he stated Mr Ovens had been warned previously for his use of the whip on a beaten runner. He said the starting point for this offence was $300 but sought a fine of $200.

Mr Ovens said he had a good record and had admitted the breach. He was not full time employed in the industry and believed a fine of $100 was appropriate.

Reasons For Penalty:

The committee takes into account Mr Ovens’ early admission of the breach, his excellent record and his cooperation with the Stewards. His use of the whip, while unnecessary, is at the lower end of the scale.

Penalty:

Mr Ovens is fined $150 and reminded of his obligations under the Rules of HRNZ.
