Decision:

In these circumstances Rule 870(5) requires us to relegate Arran Chief to behind Katies Invasion.

Amended placings are:

1st    6    The Zigmeister

2nd   11  Trial Separation

3rd    5    Katies Invasion

4th    7    Arran Chief

Stakes and dividends are to be paid accordingly.

Facts:

At the conclusion of Race 1, the Kirk Irrigation Trot, an information was lodged by Mr Renault under Rule 870(5) alleging Arran Chief broke over the concluding stages and was lapped on by Katies Invasion.

The official placings were:

1st    6    The Zigmeister

2nd   11  Trial Separation

3rd    7    Arran Chief

4th    5    Katies Invasion

The official margin between 3rd and 4th was a ½ head.

Rule 870(5) states: Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the judicial committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to rule 869(8)) such relegation of the horse shall be at the discretion of the judicial committee.

Mr A Faulkes, the driver of Arran Chief, indicated on the information that he represented the connections of that horse and did not contest the protest.

Submissions for Decision:

Mr Renault demonstrated that Arran Chief, when mounting a run down the middle of the track, galloped inside the final 50m.  Arran Chief was lapped on by Katies Invasion. 

Reasons for Decision:

We are satisfied that Arran Chief galloped with some 30-40m to race.  The horse, which had not suffered interference from any other runner, continued to cross the line in a gallop.  It was lapped on by Katies Invasion, which was finishing along the running rail well.
