Mr Saejorhor admitted the breach and it is found proved.

Penalty:

Mr Saejorhor is suspended from the completion of racing on the 9th June up to and including the 21st June 2019 (8 days).

Facts:

Following the running of the Maxwelton Pony Stud & Blair-Edie Genetics Maiden 1840 Stewards lodged an information alleging Mr G Saejorhor rode carelessly when he ”…permitted his mount (Fine And Dundee) to shift outwards near the 75m mark causing Acre (J Fawcett) to be checked.”

Mr Saejorhor appeared at the hearing and admitted the breach. He was assisted by Mr D Walsh – Jockey Mentor. 

Mr McLaughlin, with the aid of the videos, pointed out the relevant positions of Fine And Dandee and Acre as they approached the 150m mark. He stated Fine And Dandee was leading the field near the running rail, with Acre about four widths out and trailing other runners. Approaching the 100m mark Mr Saejorhor drew his whip and struck Fine And Dandee several times. Fine And Dandee shifted outwards slightly and Mr Saejorhor corrected his line. However, he again used his whip and in doing so began to drift outwards and about the 75m mark he took the line of Acre, which was mounting a challenge. Miss Fawcett was forced to check her mount, losing momentum and Acre’s chances of finishing in a better position.

Mr Saejorhor stated he made a mistake. Mr Walsh said Mr Saejorhor had put himself in a good position. But, he said he kept using the whip which he should not have done once his mount started to drift.

Submissions for Penalty:

Mr Davidson said Mr Saejorhor had a previous breach of the rule on the 31st March and was suspended for seven days. His record over the past 12 months was reasonable and he had admitted the charge at the first opportunity. However, he said Acre was denied an opportunity to finish in a stake bearing position. He said the interference was mid-range and sought a suspension starting point of 8 days.

Mr Saejorhor stated he had a good record over the past 12 months. He was not seeking a deferment.

Reasons for Penalty:

Mr Saejorhor admitted the breach at the outset and his record is good despite a recent suspension in March this year. The level of interference was mid-range and cost a horse a chance of running in a better position. Mr Davidson sought a suspension of eight days. We take a starting point of eight days and do not see any need to increase that. The result of the interference is an aggravating feature and we don’t give any credit.
