----FACTS
--At the Waimate Racing Club's meeting on Sunday, 15 July 2007, assistant Stipendiary Steward, Mr M Humphries preferred a charge against Mr J. Bates alleging that Mr Bates had wilfully or without reasonable cause accepted a ride at weight which he could not comply with.
----Mr Bates admitted the charge, which is therefore deemed to be proved.
----The evidence from Mr Humphries was that Mr Bates accepted a ride on the horse "Just Rhythm" at a weight of 53.5kg. When, Mr Bates went to weigh out, his weight was 54.5kg, which was 1kg above the allowable limit.
----In explanation, Mr Bates advised that one week ago, that he had ridden at Ashburton at 53.5kg and was therefore confident that he would be able to make the appropriate weight.
----However, in the week leading up to the Waimate meeting, Mr Bates explains the weather had been particularly cold and that he had not exercised or taken the measures that he normally takes to keep his weight in control.
----Insofar as penalty is concerned, Mr Humphries told the committee that he felt that a fine was appropriate. He said Mr Bates has not been charged under Rule 520 (4) (c) before. He said that Mr Bates has a good professional approach to his riding weight.
----He submitted that a modest fine was appropriate in the circumstances.
----PENALTY DECISION
--Mr Bates,
----We have taken into account what you have said with regard to the question of penalty and the reason as to why you did not make this particular weight. We have taken into account your good record and your early guilty plea. The charge under this rule is actually a little more serious than a lot of people give credit for, because of the fact it in inconveniences quite a range of people. It inconveniences the trainer, the owner and as much as anything, the betting public. So it must not be considered that this charge will be treated lightly because we do not think that people should have such an attitude.
----However, we have taken into account the matters that we referred to above and the fact the weather has been cold in the last week and that you have not taken the measures you would normally take with regard to your weight control. The starting point for the fine would normally have been $250-$300. We have given consideration to the penalties that have been imposed by other Judicial Committee in the past for this offence. But in this case, having regard to the factors that we mentioned, we are prepared to impose a fine of $200.00.
