FACTS

Following the running of race number 1 at the Waimate Racing Club's meeting on Sunday, 15 July 2007, assistant Stipendiary Steward, Mr M Humphries brought a charge against T Hazlett pursuant to rule 530 (2) (b) of the Rules of Racing. It was alleged that Mr Hazlett, the rider of "Torrent" struck his mount with the whip in an excessive manner for some distance near the 900-metre mark.

When presenting his case, Mr Humphries stated that the emphasis was on "excessive" rather than unnecessary.

Mr Hazlett admitted the charge, which is therefore deemed to be proved.

Mr Humphries then showed to us video coverage of the incident from which was observed, that Mr Hazlett struck his horse at least 24 times in a continuous manner near the 900-metre mark.

Mr Hazlett was invited to comment on the incident. He stated that whilst the video coverage demonstrated at least 24 strokes of the whip, he asked the Judicial Committee to consider that the majority of the strokes were when he was holding the whip in the back hand, and that the impact of such action would not have been significant on the horse.

He also told the committee that when his mount returned to the birdcage that there were no marks on the horse. He asked us to note that the horse has a tendency to "knock off". He says he is a reasonably aggressive rider, but does not "bash a horse unnecessarily".

Mr Humphries submitted to us that a fine was the appropriate penalty in the circumstances and stated that Mr Hazlett was a "genuine rider who has always worked well with the Stipendiary Stewards. He stated that he was firmly of the view that a suspension was not warranted.

PENALTY DECISION

We have given consideration to a number of matters in considering the question of penalty. The first and most important matter we have taken into account is the attitude often somewhat misinformed, of the view the public take to incidents such as this, and there would be some television viewers who would not know what you have told us today, and would assume that you were in fact, flogging this horse quite seriously. However, we have accepted what you have said and we also taken into account the matters that Mr Humphrey has told us about your good record. And we are aware of your status as a steeplechase and hurdle rider.

The starting point for penalty so far as we are concerned would have been a fine of $300.00, but after taking into account the various matters by way of mitigation and the fact that you have admitted the charge at the earliest stage, we instead impose a fine of $200.00.
