Ms Black has admitted the charge, which we thus find proved.

Penalty:

Ms Black is suspended from riding at the end of today’s meeting up to and including 17 June. This is in effect one South Island day.

Facts:

Mr Tidmarsh alleged that Ms Black failed to make the contract weight for PENNYS FROM HEAVEN (54.5 kg) in race 1.

Mr Tidmarsh stated that the respondent approached the Stipendiary Stewards when weighing out for race 1 and said she was unable to make the weight for PENNYS FROM HEAVEN (54.5 kg). She was 55.7 or 55.8. When questioned by the Committee, Mr Tidmarsh said that the trainer was unhappy that he had had to replace his jockey but Ms Barnes was available, and she was similarly experienced to Ms Black.

Ms Black explained she was currently dependent on her teenage son for transport to the races. She had had difficulty in getting him out of bed this morning to get her to the racecourse in time for a run around the racecourse in her gear before the first race. She said she did this at a meeting as a matter of course to shed a little weight. She added that she also had difficulties in using a sauna at the present time.

Submissions for Penalty:

Mr Tidmarsh produced the respondent’s record, which showed 2 breaches within the past 120 days. She had been fined on both of these occasions. He submitted a fine of $300 was appropriate on this occasion.

Ms Black submitted that the penalty should be a suspension. Mr Tidmarsh replied that a penalty of one day had recently been imposed on Mr Bothamley for an offence of this nature.

Reasons for Penalty:

Having regard to Ms Black’s record, her explanation for, and admission of, the breach, we believe a suspension is appropriate. In the interests of consistency, this should be one day to accord with the penalty imposed on Mr Bothamley at Cromwell earlier this year.
