Mr Bohorun admitted the charge and it is found proved.

Mr Bohorun is suspended for four weeks, from the conclusion of racing today up to and including July 9th 2017.

Facts:

Mr McLaughlin filed and information alleging Mr Bohorun rode incompetently by being so far in front and failing to give his mount (COME FLY WITH ME) any respite in the R & D Goodeve Waimate Cup.

Rule 638 reads

(1)   A rider shall not ride a horse in a manner which the Judicial Committee considers to be

(e) incompetent

Mr Bohorun attended the hearing and was assisted throughout by his employer and COME FLY WITH ME’s trainer Mr Blair-Edie. Mr Bohorun admitted the breach.

Mr McLaughlin, with the assistance of the video replays, outlined his concerns regarding Mr Bohorun’s ride. He said from the jump (2200m) Mr Bohorun took COME FLY WITH ME to the lead with the field in single file. From the 1700m to 1400m mark Mr Bohorun increased the tempo and about the 1400m mark he looked back to see where the other runners were. At this point he was about six lengths in front.

About the 1000m mark COME FLY WITH ME was about 50m clear of the pack. Mr Bohorun looked back again and when questioned by the stewards thought he was still six lengths in front. However, from this point Mr Bohorun keeps pushing his mount forward until the 600m mark. On entering the straight Mr Bohorun allows his mount to run outwards from the rail position to a three wide position before dropping his rein. The horse runs back inwards and Mr Bohorun gathers the rein and continues to ride his mount out to the finish. COME FLY WITH ME finished fourth a half neck from third placed BELLE BOY.

Mr McLaughlin said Mr Bohorun had failed to give his mount any respite from the 1400m onwards. He had pushed his horse forward from that point and had also dropped a rein on entering the home straight. When questioned by the stewards he admitted he had not realised how far in front he was. Mr McLaughlin stated the betting public required a higher standard of riding than shown by Mr Bohorun and that there was nothing positive about his ride on COME FLY WITH ME.

Mr Blair-Edie said he had walked the track with Mr Bohorun the day before the meeting. He had again walked the track on the morning of the races with both Mr Bohorun and Mr Walsh. His instructions to Mr Bohorun were to take the lead with COME FLY WITH ME and keep a couple of lengths clear until the top of the hill (about 700m). From that point his instructions were for Mr Bohorun to “go for it”. He was extremely disappointed with the ride but acknowledged his instructions to Mr Bohorun may have misinterpreted due to a language problem. He also believed Mr Bohorun may have become overwhelmed and became under pressure and made the mistake of not realising how far in front of the field he was during the running. He said COME FLY WITH ME had an excellent track record having won four times and placed once. Mr Bohorun had only been riding since February this year and had had 16 rides previously.

Mr Bohorun admitted he had made a really big mistake. He said COME FLY WITH ME was a free rolling runner and got into it and he hadn’t realised he had got so far clear.

Submissions for Penalty:

Mr McLaughlin stated Mr Bohorun was an apprentice jockey with limited experience and had difficulties with the language barrier. Also COME FLY WITH ME was a free rolling mare and Mr Bohorun was unaware of how far ahead he was. However, the betting public and the connections of COME FLY WITH ME expected better. He was seeking a suspension of three to four weeks.

Mr Blair-Edie said Mr Bohorun was ideally weighted for tracks during the winter and would improve with more experience on the track. He believed a minimum penalty would be adequate.

Reasons for Penalty:

The stewards sought a suspension of three to four weeks. We adopt a four week penalty as a starting point. The two aggravating features are that Mr Bohorun allowed his mount to distance itself from the field, clearly against the instructions given to him by Mr Blair-Edie, and that he dropped his rein on entering the home straight. For these two factors we increase the starting point to six weeks suspension. In mitigation we take into account that Mr Bohorun is an apprentice jockey with limited experience, his guilty plea and accept that he made a mistake, albeit a big one. We also take into account that all the parties agreed that the mare was a free roller which may have contributed to Mr Bohorun’s misjudgement of the distance he put on the field. We also take into account that COME FLY WITH ME finished in a stake bearing position (4th) and only a half neck from third placing. For those three factors we give Mr Bohorun two weeks credit.
