Facts:
Following the running of race 1 the Leithfield Nursery/Iris Pointer Memorial Trot Stipendiary Steward Mr N Ydgren filed an information alleging Junior Horseman Mr B Williamson breached the Push Out Rule with approximately 1100m to run when shifting Giventake outwards forcing Hey Caesar (Ms T Healy) wider on the track.
Rule 869 (4) (6 (b) reads:
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse and its progress.
(6) (b) a horse making a forward movement during any race shall not be forced to race wider on the track.
Mr Williamson admitted the breach and appeared at the hearing.
Mr Ydgren stated that Mr Williamson (Giventake) was in the one-out one-back position as the field neared the 1100m mark. Ms Healy (Hey Caesar) was trailing Giventake and shifted outwards to improve three wide towards the leader. When Hey Caesar was well up on the outside of Giventake Mr Williamson shifted outwards forcing Hey Caesar four wide. He said it was a clear breach of the rule. Neither horse finished in a stake bearing position.
Mr Williamson stated his horse had been hanging throughout. He had attempted to shift outwards prior to Hey Caesar moving up on his outer but due to the horse's manners was late moving.
Submissions for Penalty:
Mr Ydgren stated Mr Williamson had an excellent record, had admitted the breach and had been fully cooperative with the Stewards. He had had 1145 lifetime drives, with 261 drives this season. He sought a fine between $150 and $200.
Mr Williamson accepted a fine as being the appropriate penalty. He stated his record was good and had admitted the charge.
Reasons for Penalty:
This is a clear breach of the push out rule. Ms Healy was outside Mr Williamson for some time before he came out. On setting penalty, Mr Williamson has been given credit for his excellent record, which is clear under this rule for the past 2 seasons, and his early admission of the breach. We also note that he is a junior driver.
