Facts:

Ms P Wakelin was charged with excessive use of the whip r 869 (2) & Whip/Rein Regulations following Race 6. The Stewards alleged Ms Wakelin used her whip in more than a wrist flicking action in the home straight. Ms Wakelin admitted the breach and appeared at the hearing.

Mr McIntyre, with the aid of the video replays, stated that Ms Wakelin (BK Dawn) was finishing strongly down the outside. He said Ms Wakelin was using her whip with more than a flick from about the 200 metre mark. He said it was clearly excessive.

Ms Wakelin stated she thought she had her whip action right. She had not been driving a lot and needed to work on her whip action.

Submissions for Penalty:

Ms Haley said Ms Wakelin had just over 1000 lifetime drives and had driven 39 times this season. She had an excellent record and this was the first breach of this Rule. She had been spoken to by the Stewards regarding her whip action on two previous occasions. Stewards viewed the breach at the low end of the scale and sought a $200 fine.

Ms Wakelin made no submissions as to penalty. 

Reasons for Penalty:

Ms Wakelin has an excellent record and admitted the breach at the outset. While her use of the whip was excessive in its action it was at the low end of the scale and a fine for a first offence is appropriate.
