Facts:
Following the running of Race 7 the Skevington Contracting/Airpark Canterbury Trot Stewards charged Ms J Young with a breach of r 869 (3) (b), careless driving. The Information alleged that Ms Young “… drove carelessly by allowing her runner (AVEROSS DON) to strike the sulky wheel of CLIFDEN CLOWERS and break.”
Rule 869 (3) (b) reads:
No horseman in any race shall drive (b) carelessly.
Ms Young admitted the charge and appeared at the hearing.
Mr Munro, with the aid of the videos, stated Ms Young was midfield on the pole line approaching the home straight. He said about the 350 metre mark AVEROSS DON struck the wheel of CLIFDEN CLOWERS and broke, losing any chance.
Ms Young stated that AVEROSS DON was travelling well leading up to the incident. She said as the field bunched up on the turn AVEROSS DON got keen and when the field spread out he went for a gap and struck a wheel.

Mr Munro stated that Ms Young is a busy driver. She‘d had 1196 lifetime drives, 112 last season and 116 this season. She had a previous careless driving charge on the 16th November last year and was suspended for 2 days. As it was Ms Young’s second offence he sought a suspension of three days.
Ms Young preferred a suspension as opposed to a fine and asked for a deferment to be taken into account. She had 2-3 drives per meeting and drove mostly in the Canterbury region.
Reasons for Penalty:
Ms Young admitted a careless driving charge. The aggravating feature is this is Ms Young’s second charge inside four months and her horse lost any chance. We take a starting point of four days suspension. The mitigating factors are that Ms Young cooperated fully with the Stewards, she admitted the breach at the first opportunity and that AVEROSS DON contributed to the incident. We give Ms Young one day’s credit for those factors. Ms Young asked for a deferment which allows her to drive up until Addington on the 3rd March 2019.
