Facts:

Following the running of Race 8 the Tipplers Bar & Café/Palamountains Trot, Stewards charged Miss K Butt with a breach of r 869(7A)(a) in that “Miss Butt failed to ensure that contact was not made with track markers over the early stages of the home straight”.

Rule 869 (7A) (a) reads: Every horseman who moves inwards shall ensure:
(a) That contact is not made with any track marker.

Miss Butt admitted the charge and did not attend the hearing.

Mr Tidmarsh, with the aid of the video replays, said LANDORA'S LASSIE (Miss Butt) was last of the field when entering the home straight. He stated Mr Williams (IMRAN KHAN), who was in front of her, shifted inwards onto several marker pegs but then shifted back outwards onto the course proper. In contrast Miss Butt shifted her horse inwards onto the pegs and ended up racing inside the marker pegs for some distance. When spoken too by the Stewards Miss Butt stated she had not realised there were any marker pegs and on viewing the videos admitted the breach.

Mr Tidmarsh stated Miss Butt had had 101 drives this season and over 200 drives last season. He stated she was one of the busier Junior Drivers. Miss Butt had no previous breaches of the rule and had admitted the charge. The JCA Penalty Guide recommended a starting point of $100 fine.
