Facts:

Following the running of R # 9 the Bishopdale-Bush Inn TAB & Tavern Harewood Mobile Pace Stipendiary Steward Mr S Wallis lodged an information alleging Mr S Moore (Extreme Force) was in breach of rule 869 (2) (a) – excessive use of the whip. The information alleged that…Mr Moore used his whip excessively in the home straight.

Rule 869 (2) (a) provides for the following:-

No horseman shall during any race

use his whip in an unnecessary, excessive or improper manner.

Mr Wallis demonstrated on the video where Mr Moore (Extreme Force) was placed about four wide on the home turn and about two lengths from the lead. He said Mr Moore was seen to use his whip approximately 26 times in the home straight. He said that was excessive under the rule.

Mr Moore stated he had simply made a mistake. He was having his first drive for about 7 years and was busy driving his horse out to the finish. He stated he had only struck the shaft or the dust sheet and not the horse. Mr Moore was present at the hearing and admitted the charge.

Submissions for Penalty:

Mr Wallis said the JCA Penalty Guidelines allowed for a $300 fine or a six drive suspension. He said Mr Moore had conducted himself in a professional manner with the Stewards and had admitted the charge. It was his first drive as an Amateur Driver in six years. He was seeking a fine of $200.

Mr Moore said a fine would allow him the opportunity to source further Amateur drives. 

Reasons for Penalty:

Mr Moore used his whip approx. 26 times which puts the breach in the mid to upper range. However, at no point did he strike the horse with the whip. This reduces the range significantly to the lower end of the scale. Suspension is not an option due to the scarcity of Amateur Driver’s races programmed in the Otago/Southland region over the remainder of the season. Therefore a fine is appropriate. With a starting point of $300 Mr Moore is given credit for his early admission of the breach and also that he did not strike the horse with the whip.
