Decision:
Mr Knowles stipendiary steward, alleged that with approximately 100 metres to run MIDEWEWIN (S Dickson) moved inwards on to FERRY GLIDE (A Faulks) causing that horse to be checked. Placings were 6, 4, 11, 1, 8, 5.
--Mr Knowles demonstrated on the video that about 100 metres from the winning post MIDEWEWIN rolled inwards coming into contact with a leg of FERRY GLIDE, which was trailing the leading horse, causing that horse to be checked and break for a couple of strides. He alleged MIDEWEWIN had interfered with the chances or progress of FERRY GLIDE and sought relegation to 6th.
--Mr Faulks, driver of FERRY GLIDE, stated that he had galloped for 2 strides and the interference had cost him 5th and possibly 4th. When further questioned by the Committee, he said possibly 3rd.
--Both Mr Dickson, driver of MIDEWEWIN and Mr Stapleton, the trainer, stated that movement of other horses at the relevant time was a contributing factor.
--I am satisfied that interference was caused to FERRY GLIDE which resulted in the horse being checked and to break briefly. The cause of that interference was inwards movement from MIDEWEWIN. I do not believe any other horse contributed to the incident. However, I am satisfied that had there been no interference, FERRY GLIDE which was in the trail behind the eventual winner, would not have finished in a dividend bearing position. I believe Mr Faulks' original statement to be accurate. The 2 horses on FERRY GLIDE's outer were going as well as, if not better than that horse. There was simply no room for FERRY GLIDE to mount a run into a dividend bearing position, even were it good enough. In these circumstances I exercise my discretion and dismiss the protest. The placings are as the horses crossed the line.
