Mr Knowles alleged that Mr Hay drove carelessly when shifting outwards with approximately 250 metres to run causing interference to CHASING ANSWERS (A Malcolmson). Mr Hay admitted the breach.

--Mr Knowles demonstrated on the video that Mr Hay shifted out looking for a run and in so doing inconvenienced Mr Malcolmson who was forced onto the wheel of Mr Hanna who was racing on his outer. In effect, Mr Malcolmson was sandwiched between the 2 horses and received what he described as "a small bump". Mr Knowles acknowledged that Mr Hay took immediate corrective action, but it was too late.
--Mr Hay stated his horse was temperamental in the mouth and that when he tried to pull her down she had over-corrected.
--Mr Knowles produced Mr Hay's record which showed no breaches of this rule in the past 12 months. He described the breach as being at the lower end and recommended a fine. Taking into account the mitigating factors of the temperament of the horse, Mr Hay's excellent record and immediate admission of the breach, a fine of $200 is imposed. Mr Hay is reminded of his obligations under the Rules of Harness Racing.
