Facts:
Mr Pitman alleged that SKEEN placed 1st by the Judge interfered with the chances of LUKANDER placed 2nd by the Judge in Race 1, the OTAGO DAILY TIMES/ARMSTRONG PRESTIGE/HARBOUR R65 1975 m, with the interference occurring over the concluding stages.
Judge’s placings were:
1st - 7 SKEEN
2nd - 1 LUKANDER
3rd - 8 CRISTALLO
4th - 11 GALLANT BABE
The margin between 1st and 2nd was a nose.
Rule 642(1) states:
If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
Submissions for Decision:
Mr Pitman demonstrated on the videos that SKEEN was hanging and had forced LUKANDER wider on the track as the two horses raced side by side down the home straight.
He paused the video at a point where he alleged that LUKANDER was struck over the head with Mr Callaway’s whip. He demonstrated LUKANDER had reacted to being hit and had lost stride momentarily.
Mr Walsh, the rider of LUKANDER, said he was racing outside SKEEN and was confident he would pick up the leader in the final 200 metres. He said SKEEN had come out gradually. The critical point was the 100 metres where LUKANDER was struck over the head. He said LUKANDER had put its head up as a consequence and lost a head or a neck. He emphasised LUKANDER had come again and the margin was only a nose. He believed this had cost him the winning of the race.
Mr Callaway stated that SKEEN had been hanging out the whole way down the straight. He acknowledged he had come out but he said Mr Walsh was racing next to him and was pushing his mount out the whole time. He said his horse had also finished on over the final 100 metres. He agreed it looked like he had hit LUKANDER with his whip. He believed LUKANDER had over-reacted to this though.
Ms Clark said she reinforced Mr Callaway’s comments. She accepted SKEEN had shifted out and that LUKANDER had been hit with the whip but she believed LUKANDER had over-reacted. She also emphasised that SKEEN had fought hard to the line.
Mr Davidson, Stipendiary Steward, was given the opportunity to comment on the evidence. He believed it was clear on the films that LUKANDER had been hit with the whip and the horse had reacted. Mr Walsh had to grab his mount at this point. He added SKEEN had shifted out a long way in the run up the straight and had been under a hard ride.
Reasons for Decision:
We are satisfied SKEEN has shifted wider on the track and has forced LUKANDER to race wider a consequence. For much of this time Mr Walsh was able to ride LUKANDER out although he was racing in restricted room. Significantly, at around the 100 metres point and when the horses were racing very close together, LUKANDER was hit on the head by Mr Callaway’s whip. The horse lifted its head as a result and briefly lost momentum before finishing on strongly and gradually taking ground off SKEEN as they raced to the line.
The winning margin was only a nose. We are of the opinion that had the interference by SKEEN to LUKANDER not occurred, LUKANDER would have finished ahead of SKEEN.
