Facts:
Following the running of Race 8, the Dunedin Casino Waikouaiti Cup Handicap, an Information was filed by Stipendiary Steward, Mr M Davidson alleging M G Jogoo (Alpine Heights) breached Rule 638 (1) (d) in that ..Mr G Jogoo (Alpine Heights) allowed his mount to shift inwards near the 200 metre mark causing Ridley (R Cuneen) to be dictated inward, causing checks to Karaka Jack (T Moseley) and Recording (R Bishop).
Mr Jogoo was present at the hearing and admitted the charge.
Rule 638 (1) (d) provides:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
-(d) careless
Mr Davidson, with the use of the video replays, showed where Mr Jogoo (Alpine Heights) was about five wide nearing the 200m mark and mounting a run at the leaders. He said about the 200m mark Mr Jogoo allowed his horse to shift inwards and dictate the line of ‘Ridley’. At that point Mr Jogoo struck his horse with the whip, resulting in ‘Alpine Heights’ shifting inwards further. This caused resulting checks to ‘Karaka Jack’ and ‘Recording’.
Mr Parsons, representing Mr Jogoo, said when Mr Jogoo used his whip he did not have a hold of the horses head and this allowed ‘Alpine Heights’ to shift inwards. He said it was an error of judgement on his part.
Submissions for Penalty:
Mr Davidson said Mr Jogoo had only just started riding this season. He was an Apprentice Jockey and had an excellent record. He had no previous charges under the rules and had admitted the breach at the first opportunity. He was committed to rides at Waikouaiti on the 3rd January and Greymouth on the 4th January. He said the carelessness was mid range and was seeking a suspension of 2/3 South Island days.
Reasons for Penalty:
The committee took into account Mr Jogoo’s excellent record as an Apprentice Jockey, his early admission of the breach and his cooperation with the Stewards. The committee viewed the carelessness at the lower to mid range. Mr Jogoo was given credit for the above mitigating factors.
